DECREE OF HE COUNCIL OF STATE ON AUTHORIZED INDUSTRIAL PROPERTY AGENTS, 22.5.2014/396

By decision of the Government, the following is enacted pursuant to section 2, subsection 2; section 6, subsection 3; and section 12, subsection 2 of the Act on Authorised Industrial Property Attorneys (22/2014):

Section 1 Organisation of industrial property agent's examination

The Industrial property Agents Board approves the list of legislation, literature and other materials on which the questions in the industrial property agent’s examination are based. The date and place of the industrial property agent’s examinations are decided by The Industrial property Agents Board. These shall be announced on the website of the Finnish Patent and Registration Office no later than two months prior to the date of the examination.

Section 2 Passing the industrial property agent’s examination

All sections in the examination must be passed in order to pass the industrial property agent’s examination. The examination is graded on a pass/fail basis.

Section 3 Certificate of industrial property agent’s examination

The Industrial property Agents Board issues a qualification certificate to candidates who have passed the industrial property agent’s examination. The title of the qualification shall be patent agent, trade mark agent or design agent depending on the examination section referred to in section 2, subsection 1, paragraph 2 of the Act on the Authorised Industrial Property Agents (22/2014) passed by the candidate. The following information shall be recorded on the certificate: 1) the title of the qualification; 2) the legal provisions on which the qualification is based; 3) the name of the board issuing the certificate; 4) the personal details of the holder of the qualification; 5) the place and date of issue of the certificate. The certificate shall be signed by the chairperson and secretary of The Industrial property Agents Board or, when the chairperson is prevented from doing so, by The Industrial property Agents Board’s vice chairperson and secretary.

Section 4 Certificate of authorisation

The following information shall be recorded on the authorisation certificate: 1) the professional title of the authorised agent; 2) the legal provisions on which the authorisation is based; 3) the name of the board granting the authorisation; 4) the personal details of the authorised agent; 5) the date of issue or date of extension of validity of the authorisation;

6) the period of validity of the authorisation. The certificate shall be signed by the chairperson and secretary of The Industrial property Agents Board or, when the chairperson is prevented from doing so, by The Industrial property Agents Board’s vice chairperson and secretary.

Section 5 Consideration of matters in the Industrial property Agents Board

The Industrial property Agents Board is convened by the chairperson or, when the chairperson is prevented from doing so, by the vice chairperson. The board shall be convened when a request to this effect is made by at least three members. The Industrial property Agents Board considers matters within its competence on the presentation of the board’s secretary. The secretary of the Industrial property Agents Board shall be appointed by the board.

Section 6 Entry into force

This Decree enters into force on 1 July 2014.
