De conformidad con la excepción prevista en el artículo 90, fracción XVI, de la Ley de la Propiedad Industrial —en los términos de su redacción vigente hasta el 18 de mayo de 2018—, es procedente el registro de una marca semejante en grado de confusión a otra propiedad de un tercero cuando quien plantea la nueva solicitud ya cuenta con una marca idéntica a la que ahora propone aplicada productos y/o servicios similares, ello ponderando la ampliación de cobertura de la marca de un mismo titular hacia productos o servicios relacionados con la marca que ya tiene posicionada en el mercado, razón por la que no habrá lugar a la confusión con marcas de terceros
