卫生部、农牧渔业部、中国专利局关于用于专利程序 的微生物菌 (毒)种、培养物入境检疫暂行规定 (1985年9月10日)

一、外国申请人向我国提出涉及微生物的专利申请,将微生物菌(毒)种、培养物交中国专利局指 定的保藏单位保藏的,应事先由其委托的涉外专利代理机构向卫生部或农牧渔业部办理入境许可审批手续。 与人、环境卫生有关的微生物菌(毒)种、 培养物,由卫生部审批;与动物、植物有关的微生物菌(毒)种、培养物,由农牧渔业部审批;与人畜共患性疾病有关的,应由卫生部和农牧渔业部协商后联合审 批。审批单位一般应在收到微生物菌(毒)种、培养物入境申请后一周内,作出决定,并通知申请人。

二、审批单位根据国家颁布的有关法令、条例进行审批。对微生物菌(毒)种、培养物进口时,要 求包装绝对安全,不得造成污染。

三、涉 外专利代理机构在办理入境许可审批手续时,应向审批单位提交申请入境的微生物菌(毒)种、培养物的名称、来源、数量、用途,对人和动植物有否危害等简要资 料。

四、经审批单位同意,涉外专 利代理机构方可通知外国专利申请人将微生物菌(毒)种、培养物寄入我国或携带入境。进口时涉外专利代理机构应将外国委托人的有关证明及审批单位的许可单向 进口的国境卫生检疫机关或口岸动植物检疫机关报检。国境卫生检疫机关或口岸动植物检疫机关接受报检后,应及时查检,放行。若发现进口的微生物菌(毒)种、 培养物与证件不符,或包装不符合要求,即予以退回或没收销毁。

五、微生物菌(毒)种、培养物保藏单位应对微生物菌(毒)种、培养物妥善保藏,确保安全,严防 扩散。

六、任何人要求获取用于专 利程序的微生物菌(毒)种、培养物样品供国内使用的,除按中国专利局《用于专利程序的微生物保藏办法》办理外,均应经卫生部或农牧渔业部批准。
