1. These Rulesmaybecitedasthe _{Short title.}

TRADE MARKS RULES.

2. Inthese Rules, unless the context otherwise requires- Interpretation.

“agent” meansan attorney-at-lawwhoisresidentinBelizeand practicingin Belizeinaccordancewiththe relevantlaw; “applicant”inrelationtoan application submittedtothe Registrar,meansthe

personwho submitsthe applicationoron whose behalfitissubmitted;

“opponent” meansapersonwho opposesan applicationfor registrationor whoopposessomeother applicationmadeundertheAct; “Office” meansthe OfficeofIntellectual Property; “Registrar”meanstheRegistrarofIntellectualPropertyappointedundersection CAP.253.

^Feesand 3. (1) Thefeestobepaidinrelationtomarksarethoseprescribedin payment.

PaymentsshallbemadeinBelizeancurrency,buttheequivalent amountinaforeigncurrencythatisconvertibleinBelizemaybeaccepted.

(3)

Whenafeepaidbyapersontothe Registrarforany purpose exceedsthefeefixedbytheseRulesforthat purposebymorethan$10,the personwhopaidthefeeis entitledtobe refundedthe amountof excessless $10.

(4)

Feesthatarepaidbycheque,bankdraftormoneyordershall be forwarded to the Registrar and made payable to him.

(5) Feesmaybepaidbycashatthe Office.

(6)

ApaymentofafeebychequemaybeacceptedbytheRegistrar asbeingapaymentofthefeewhenthechequeisreceivedbyhim;but,ifthe chequeisnotpaidwhen presentedtothebankonwhichitisdrawnandnot madegoodwithinsuchtimeastheRegistrarmayfix,the acceptanceofthefee isrevokedandanythingdone pursuanttothe paymentisvoidand,ifappropriate, shallbeso recordedinthe register.

(7)

Whenafeeispaidtothe Registrarbyany personbymistake, foran applicationthatiswithdrawnbeforeitifgivenan applicationnumber,or foraservicethatcannotbeprovided,thepersonwhopaidthefeeisentitledto arefund of the fee less $25, if he claims the refund within one year of the paymentofthe fee.

(8) Whenapersonpaysafeein advanceforthe registrationof markorforanyother purpose,heis entitledtoarefundofthatfee,less$15, ifhedecidesnottoproceedwiththe applicationfor registrationofthemarkof otherpurposetothestagewherethefeewouldbe required.

1. In submittingadocumentforany purposeoftheActor these Rules, thepersonsubmittingthe documentmustusetheFormsetoutinScheduleII thatisapplicable.
2. (1) All applications, notice, statements, papers having representationsaffixed,or other documents authorizedor requiredbytheAct ortheseRulestobemade,leftwithorsenttothe Registrarmustbeonstrong, durable white paper and, except in the case of statutory documents and affidavits,mustbewrittenononesideofthepaperonly.

(2)

Eachsheetofpaper(otherthan representations)musthaveits short sidesatthetopand bottomofthe sheet.

(3)

Each sheet of paper must be of the same size and on A-4 paper or such other size as the Registrar may permit.

6. (1) The papersof documents, other than representations, must benumbered consecutively,preferablyatthetopofthe page.

(2) Page margins mustbeapproximately2cm.

(3) Exceptfor representations,pagesmustbetypedorprinted preferablywithoneandahalf spacingor double spacing.

7. (1) Anapplication mustbeinEnglish.

1. Aregistered owneror licenseeofamark,orany addressfor person abouttobe registeredor recordedasa registered owneror licenseeofa mark,may,ifheso desires,giveonthe appropriateforman addressfor service tobeenteredintheregister,andthat addressmaybeenteredintheregisterby the Registrar.
2. All applicationsinFormNo.1foran addressfor servicemustbesigned bythe applicant,orbyanagent expressly authorizedforthe purposebythe applicant.
3. Whenno addressfor serviceisenteredinthe registerforaregistered owneror licenseeofamark,theRegistrarmaytreatthetradeor business addressofthe registered owneror licenseeas recordedinthe registerasthe addressfor serviceofthat owneror licenseeforall purposes connectedwith the registrationofthe mark.
4. Awritten communicationtoapersonorparty communicationmentioned intheActortheseRulesand addressedtoan addressgivenbyhimtothe Registraror treatedbythe Registrarasthatperson’sorparty’saddressfor serviceshallbedeemedtobeproperly addressedtothatpersonorparty.

14:01. Wherearegisteredtrademarkhascompleteditstenthanniversaryof registrationandatleastsixmonths thereafterno applicationhasbeenmadeto renewit,theRegistrarshallallowsuchtrademarktobere-registeredonthe Register,andthe provisionsoftheActand these Rules relatingtothe registration oftrademarks,includingthepaymentofthe relevantfees,shallapplytosuch re-registration, which shallforall purposesbedeemedtobearegistration.

(ii)

betweenaregistered owneroralicenseeof a mark and the Registrar or any other person,

maybemade,signedorgiven throughan agent.

(2) Anypersonreferredtoinsub-rule(1)otherthantheRegistrar may,bysigningandsendingtothe Registraran authorityinFormNo.2,appoint anagenttoactforthatpersoninany proceedingsormatterbeforeoraffecting the Registrar undertheActor these Rules.

(3) Where an agent has been appointed pursuant to these Rules

(a)

serviceupontheagentofany document relatingto the proceedings or matter for which the agent has been appointed is service upon the person who appointed him;

(b)

all communications that relate to any proceedings or matter referred to in paragraph (a) that are directed to be made to any applicant, person making a request or giving a notice, or to any registered owner or licensee, may be addressed to his agent; and

(c)

all attendances upon the Registrar relating to any proceedingsor matter referredtoin paragraph(a)

(4) The Registrarmay,inaparticular case, requirethe personal signatureor presenceofan applicant, opponent, registered owneror licensee or other person notwithstanding that an agent has been appointed for the applicant, opponent, registered owner,licensee or other person.

Non-Registrable Marks

16. (1) Subject to sub-rule (3), the Registrar shall refuse to accept anyapplicationforthe registrationofamarkuponwhichanyofthefollowing

appear
	(a)	the words “standard”, “patent”, “patented”, “registered”, “industrial design” or “copyright”;
	(b)	the Royal Arms, Royal Crest or Royal Standard;
	(c)	the arms or crest or any member of the Royal Family;
	(d)	any word or symbol likely to lead to the belief that the goods or services in the application have received or are produced, sold or performed under royal, vice-regal or governmental patronage or authority;
	(e)	the arms, crest or flag adopted and used at any time byBelize;
	(f)	the words “Red Cross” or “Geneva Cross” or representation of the Geneva Cross in red on a white ground or the Swiss Federal Cross in white or silver on a red ground as protected by the

Duty to refuse.

(g)

the heraldic emblemoftheRed Crescentona white ground as protected by the Geneva Conventionof 1949;

(i)

the name representationofany person;

(j)

any marks referred to in sections 36, 62, or 63 of the Act and not included within paragraphs

(a) to (i) of this rule.

(2)

TheRegistrarshallgivenoticeintheGazetteofallmarksthe registrationofwhichisprohibited pursuantto paragraph (j)ofsub-rule(1)of this rule.

(3)

Exceptamark referredtoinparagraph (a)ofsubrule(1)of thisrule,theRegistrarmayregisteramark otherwiseprohibitedfor registration underthisrule,if consenttothe registrationisgivenbyoron behalfofHer Majestyorsuchother person,society,authorityororganizationasisprotected against unauthorized registrationbytheActorthisrule.

statesthatthe nameor descriptionofgoodsor serviceswillvarywhenthe markissuedupongoodsor servicesotherthanthegoodsor servicesappearing in the mark, permit the registration of the mark for the goods or services appearing on the mark and the other goods and services.

Application for Registration

1. Anapplicationforthe registrationofamarkinrespectofanygoods or servicesmustbemadetothe RegistrarinFormNo.3.
2. (1) An application for registration of a mark must contain a representationofthemarkinthespaceprovidedintheformforthat purpose.

(2)

The representationofthemarkrequiredbysection12(2)(d) oftheActmaybeinblackandwhiteandcolourcodedifnecessarybutitmust besuitable for reproduction.

(3)

Whenthesizeofarepresentationofamark exceedsthespace providedforitinthe applicationform,the representationmustbemountedon such strong paper or other material as the Registrar considers suitable, and partofthe representation mustbeaffixedtothe applicationinthe space provided forthe representationandthe restofthe representation folded.

(4)

If for any reason the Registrar is dissatisfied with the representationofamarkinan application,the Registrarmay,before proceeding withthe application,requirethatanother representationbesubstitutedthatis satisfactorytohim.

21. (1) Whenamarkappliedforcontainslettersorwordsincharacters otherthanRoman,then,unlesstheRegistrar otherwisedirects,asufficient transliterationor translationofthelettersorwordssatisfactorytotheRegistrar mustbeendorsedonthe applicationform;andthe endorsementmust indicate the languagetowhichthewordsor lettersbelongandbesignedbythe applicant or his agent.

(2) Whenamarkappliedforcontainsawordinalanguageother thanEnglish,atranslationoftheword satisfactorytotheRegistrarmustbe endorsedontheapplicationform;andtheendorsementmustindicatethelanguage towhichthewordbelongsandbesignedbythe applicantorhisagent.

22. (1) Anapplicantforthe registrationofamarkwhoisunder section 56oftheAct availing himselfofthe priorityofan earlier applicationinacountry thatisamemberofthe Paris Convention must submithis applicationtothe Registrarwithin6monthsofthemakingoftheearlier application.

(2) Thecopyoftheearlierapplicationmustbesubmittedwithin90 daysfromthedateofthe applicationtotheRegistrarandmustbeinEnglish;if thecopyofthe earlier applicationisnotinEnglish,itmustbeaccompaniedwith atranslation satisfactorytothe Registrarandduly endorsedbythe applicantor his agent.

23. (1) Achangeof nameor changeof addressofan applicantora changeofhisaddressforservicemustbenotifiedtotheRegistrarbyasubmission fromthe applicantinFormNo.4,togetherwiththe prescribedfee,butinthe caseofachangeofnameevidence satisfactorytotheRegistrarmust accompany the submission.

(2) TheRegistrarshallrecognizethechangeofaddress,orchange ofaddressfor service,ofan applicant;andwhenthe Registrarissatisfiedbythe evidence submittedtohim,heshallrecognizethechangeofnameofanapplicant.

24. Atransferofapplicationforthe registrationofamarkmayberecognized bythe Registraronthe submissiontohimofan applicationinFormNo.5bythe transfereeofthe application, togetherwiththe prescribedfeeand evidence satisfactorytothe Registrarthatthemarkhasbeen transferredtothe transferee ofthe application;andiftheRegistrarissatisfiedthattheapplicationfor registration ofthemarkhasbeen transferredtothe transferee,heshalltreatthe transferee as the applicant thereafter.

Procedureonreceiving application forregistration

25. (1) Onreceiptofan applicationforthe registrationofamark,the Searchof Registrar shall havea search madeof the registered marks and pending register. applicationsofrecordinthe officetoascertain whether thereisrecorded therein, inrespectofthe samegoodsor servicesor descriptionofgoodsor services, anymark identicalwiththemarkappliedfororsonearlyresemblingitthatit would likely mislead the public.

(2) At any time before the acceptance of an application, the Registrar may renew a search made under sub-rule (1) in respect of the application,butthe Registrarisnotboundtodoso.

26. (1) After a search of his records pursuant to rule 25 and a Result of considerationofthe application,the Registrarmay acceptthe application ^{consideration.} absolutely,objecttothe registrationofthe applicationorrequiretheapplicant tofurnishevidenceofuseorofdistinctivenessorofanyothermatter.

(2) If, afteran examiningofany evidence furnished pursuantto sub-rule(1),the Registrarisnot satisfiedthatthemarkoughttoberegistered, hemayeitherobjecttothe registrationoftheapplicationorexpressawillingness toacceptthe applicationsubjecttosuch conditions, amendments, disclaimers, modifications,or limitationsofthe applicationasthe Registrarmay impose.

27. (1) Whenthe Registrar objectstothe registrationofanapplication, Consequence of the Registrar shall in writing inform the applicant of his objection to the objection. registration.

(2) When, after the Registrar objects to the registration of an application,the applicantdoesnot,within60daysofhisreceiptofthe objection, deliverorsendtothe Registrarawrittenreplytothe objections,the applicant shallbedeemedtohave withdrawnhis application.

^Conditional 28. (1) When the Registrar is willing to accept an application for acceptance.

registrationifitissubjectedtoanycondition, amendment, disclaimer,modification or limitation,theRegistrarmayinwriting communicatethis circumstancetothe applicant;andifthe applicantdoesnotobjecttothe condition, amendment, disclaimer,modificationor limitation,heshall,within30daysafterreceiptofthe communication, so inform the Registrar and alter his application accordingly.

(2) If an applicant described in sub-rule (1) falls to notify the Registrarasrequiredbythat sub-ruleanddoesnotobjectunderrule29within the time provided therefore, he shall be deemed to have withdrawn his application.

^62of2002. (3) Whereany applicationforthe registrationofatrademarkis amendedinanyformor manner,thereshallbepaidapublicationfeeofone hundred dollarsforthe publicationofthe amendmentinoneissueofthe Gazette.

^{Objection to} 29. (1) When an applicant objects to a condition, amendment, condition, etc..

disclaimer,modificationor limitationimposedbytheRegistrarpursuanttorule 28,theapplicantshall,within60daysfromthereceiptofthe communicationto himofthe condition, amendment, disclaimer,modificationor limitation,notify the Registrarinwritingofhis objectionandthe reasons therefore.

(2) After considerationanotification under sub-rule(1)byan applicant,the Registrarshallmakeadeterminationinthe matter;andifthe applicantdoesnotappealthe determinationundersection70oftheActwithin 14daysafterthe determinationismadeknowntohim,the applicantshallbe deemedtohave withdrawnhis application.

Disclaimer. 30. Atanytimebeforeamarkforwhich registrationhasbeenappliedis recordedinthe register,the Registrarmay requirethe applicantto insertinhis applicationadisclaimerofany matterthatisnot independentlycapableofbeing registeredsothatifthemarkisregisteredthepublicwill understandthe extent ofthe applicant’srights after registration.

Collective or Certification Marks

31. (1) Whenan applicationismadeforthe registrationofacollectiveor Examinationof collective or

certificationmark,the Registrarshall,inadditiontotheother examinationsofthe

certification

applicationthatisrequiredtobemadebytheActandthese regulations,examine

marks.

the applicationand accompanying regulationstoensurethattheycomplywiththe First and Second Schedules to the Act.

(2) The regulations accompanyingthe applicationmustbeexamined to ensure that

(a)

the common characteristicsor common qualityofthe goods or services to which the collective or certificationmarkistobeappliedissetoutinsufficient detail to identify the common characteristics or quality;

(b)

the regulations contain the conditions and restrictions under which the collective or certification mark can be used;

(c)

the regulations statethatthe ownerofthe collective or certification mark can receive samplesof any goods,or inspectthe deliveryofanyofthe services, associated with the collective mark, or inspect, during normal businesshours,theplaceof manufactureof the goods or the place where the services are performed, to ensure that the common characteristics or commonqualityisbeing maintained;and

(d)

the regulations contain some meansbywhich the ownerof the collective or certification mark can prevent its use if anyone uses it in contravention of the conditions governing its use.

Entry in Register

1. Whenan applicantforthe registrationofamark becomes entitled undersection18oftheActtohavethemark registered,theRegistrarshall,on receiptofthe prescribedfeeandacompletedFormNo.9,recordthemarkin the register.
1. Whenanapplicantfortheregistrationofamarkdiesbeforehebecomes entitledundersection18oftheActtohavethemark registered,theRegistrar may,onbeing satisfied
1. of the death of the applicant; and
2. ofthe ownershipofthemarkbyanother person, enter in the register,in place of the name of the deceased applicant, the name, address and trade or business descriptionofthe person owningthe mark.

PARTIII RENEWALOFTRADE MARKS

Renewal

39. (1) Atanytimenotbeing morethan12months beforethe expiration ofthe registrationofamark,the registered ownerofthemarkoraduly recorded licenseeofthemarkmayfilean applicationinFormNo.11,togetherwiththe prescribedfee,for renewalofthe registrationofthe mark.

(2) An application mentioned in sub-rule (1) must contain the following statement

(a) that the mark has been used

(i) bythe registered owner in respect of all of thegoodsor servicesinthe registration;or

(b) that the mark has been used

(i)

bythe registered ownerin respectof some ofthegoodsor servicesinthe registration, specifying the goods or services so used; or

(ii)

byanamed licenseein respectof someof the goods or services that are in the registrationandfor whichthe licenseeis entered, specifying the goods or services so used,

andstatingthe reasonsthat,beingbeyondthecontroloftheownerorlicensee, asthe case requires, would excusethe non-usein respectofthe remaining goodsor servicesinthe registration;or

(c) thatthemarkhasnotbeenusedbythe registered owneroranamed licenseein respectofanyof thegoodsor servicesinthe registration,andstating the reasons that, being beyond the control of the owner or licensee, as the case requires, would excuse the non-use of those goods or services.

(3) Whenan applicationfor renewalismadebya registered licensee,hemustcompleteFormNo.11asifhewerethe registered owner, maketherequired statements,as appropriate,inrespectofhisuseofthemark andin respectoftheuseofthemarkbyaregistered sub-licensee.

Renewing 41. (1) Inconsideringanapplicationtorenewthe registrationofamark, registration.

theRegistrarshalltakethefollowingactioninthe circumstancesdescribed, namely:

(a)

renew the registration of the mark without amendment if the registered owner or registered licensee has stated that the mark has been used on all of the goods or services in the registration or hasbeenusedon someofthegoodsor servicesin the registration and the reasons given for the non-use in respect of the remaining goods or services are sufficient to explain the non-use;

(b)

renewthe registrationinrespectofthosegoodsor servicesinthe registrationfor whichthe registered owner or registered licensee has stated that the mark is in use or for which reasons were given to excuse the non-use, and remove from the registration the remaining goods or services in respectof whichthe registered owneror registered licensee has stated that the mark is not in use and the reasons given for the non-use are not sufficient to excuse the non-use; or

(c)

refuse to renew the registration if the registered owner or registered licensee has stated that the mark has not been used in respect of any of the goodsor servicesinthe registrationandno reasons are given for the non-use or the reasons given for the non-usearenot sufficientto excusethe non-use.

Aftertakingsuchactionasis indicatedbysub-rule(1)the Registrar shall make the appropriate entries in the register and advise the applicantinwritingofthe action taken.

(3)

Uponthe renewalofatrademark,the Registrar shall issueto the registered proprietorofthe trademarkorany other person showing title thereto,aCertificateor RenewalinForm12A,setoutinthe Scheduleof theseRules,orasnearasmaybetothatFormasthe circumstancesofeach case may allow.

PARTIV LICENCE -CONTRACTS

42. (1) Alicence-contract may be recorded in the register on the submissionofan applicationinFormNo.13,togetherwiththeprescribedfee andacopyofthe licence-contract.

(2)

Upon receiptofthe application,thefeeandacopyofthe licence-contract,theRegistrarshallexaminethe licence-contracttodetermine whetheritcomplieswiththe requirementsoftheAct;andifitdoesthe Registrar shall recordinthe registerthe particularsofthe licence-contractassetoutin the application,and advisethe applicantinwritingofthe action taken.

(3)

If,afterhis examinationofanapplicationpursuanttosub-rule (2), the Registrar determines that the licence contract does not comply with the requirements of the Act, the Registrar shall refuse to record the licence-contractintheregisterandadvisetheapplicantinwritingofhis refusal to record it.

43.Apersonwhowishestocancelalicence-contractmustapplyfor cancellation in Form No. 14, pay the prescribed fee and submit with his application when necessary,evidence satisfactory to the Registrar that the licence-contract has terminated; and the Registrar shall thereupon cancel the recordinthe registerand advisethe applicantinwritingofthe cancellation.

2. (1) When, pursuanttoalicence-contractthat authorizesthe licensee tograntasub-licence,the licenseegrantssuchasub-licence,the sub-licence mayberecordedintheregisteruponthe submissionofan applicationinForm No.16,togetherwiththeprescribedfeeandacopyofthe sub-licence-contract.

(2)

Uponreceiptofan applicationin accordancewith sub-rule (1),theRegistrarshallexaminethe sub-licence-contracttoensurethatitcomplies withthe requirementsoftheAct.

(3)

IftheRegistrarissatisfiedthatthe sub-licencecomplieswith theAct,theRegistrarshallrecordintheregistertheparticularsofthe sub-licence assetoutinthe applicationandadvisetheapplicantinwritingoftheaction taken.

(4)

Ifasub-licencedoesnotcomplywiththe requirementsofthe Act,the Registrar shall refuseto recorditinthe registerand shall advisethe applicantinwritingofhis refusalandthe reasons therefor.

PARTV CHANGEIN REGISTER, SURRENDERAND TRANSFEROF MARK

46. Whenaregistered owneror licenseeofamark wishesto recorda changeof addressorotherchangenotbeingachange referredtoinRule47, he shall submit an application therefor in Form No. 17 together with the

1. Whenaregistered owneror licenseeofamark wishesto recorda changeof nameinthe register,he shall submitan applicationto changehis nameinFormNo.17togetherwiththe prescribedfeeand evidence satisfactory tothe Registrarofthechangeofname.
2. UponcompliancewiththerequirementsofRule46or47,asthecase requires,the Registrar shall recordthe changeinthe registerand advisethe applicantinwritingofthe action taken.
3. (1) Whenaregistered ownerofacollectiveor certificationmark wishes to change the conditions governing the use of the collective or certificationmarkheshallsubmitan applicationinFormNo.18togetherwith theprescribedfeeandacopyoftheregulationsinwhichthechanged conditions are set out.

(2) The Registrar shall examine the regulations and the changed conditions mentionedinsub-rule(1)andifheissatisfiedthattheycomplywith theActand these regulationshe shall causeanoticeofthe applicationtobe publishedinthe Gazette.

(3) The notice mentionedinsub-rule(1)must –

(a)

specify the registration number of the collective or certification mark;

(b)

indicate the Goods and services in respect of whichthemarkis registered;

(c)

set out the change in the conditions, governing the use of the mark; and

(d)

set out the name and address of the registered

Surrender

50. (1) When a registered owner of a registered mark wishes to surrender registrationofamark pursuantto section45oftheAct,hemust submittothe Registraran applicationto surrenderinFormNo.19, together with the prescribed fee.

(2)

TheRegistraronreceiptofasurrenderinaccordancewiththis ruleshallrecordthe surrenderintheregisterforalloranypartofthegoodsor servicesinthe registrationassetoutinthe applicationto surrenderandshall advisethe applicantinwritingofthe action taken:

Providedthatwhenalicence-contractis recordedinthe registerfora mark,asurrendermadein respectofthemarkmaynotbe recordedinthe registerunlessthe surrender containsastatementthatitwasmadewiththe consentofthe licensee underthe licence-contract.

(3)

Theprovisotosub-rule(2)doesnotapplyifthe licence-contract relatingtothemark referredtointhatprovisoexpresslywaivestherightofthe licensee underthe licence-contracttopreventthe recordingofasurrender without his consent.

Transfer of Mark

51. Atransfer of a trade mark may be recorded in the register on the submissionbythe transfereeofan applicationinFormNo.20, togetherwith the prescribedfeeand evidence satisfactorytothe Registrarofthe transferof themark,and thereuponthe Registrarshall advisethe applicantinwritingofthe action taken.

52. (1) Forthe purposeofobtainingthe approvalofthe Registrarto the transferofacollectiveor certificationmarkunder section31oftheAct, the transferoror transfereeofthe collectiveor certificationmarkmustsubmit tothe Registraran applicationinFormNo.21, togetherwiththe prescribed feeand evidence satisfactorytothe Registrarthatthe transfer complieswith the requirementsoftheAct.

(2) If the Registrar approves the transfer of a collective or certificationmark,heshallnotifythe applicantinFormNo.22.

53. (1) For the purpose of recording transfer of a collective or certificationmark,the transfereemustsubmittotheRegistraranapplicationin FormNo.23,togetherwiththe prescribedfee,the Registrar’sapprovalofthe transfer and evidence satisfactory to the Registrar that the collective or certificationmarkhasbeen transferredtothe applicant.

(2) Ifthe Registrarissatisfiedthatthe collectiveof certification mark has been transferred to the applicant, the Registrar shall record the transfereetothe registered ownerofthe registrationinaccordancewiththe information containedinthe application,andadvisetheapplicantinwritingof the action taken.

PARTVI MISCELLANEOUS

1. AnycorrespondencewiththeOfficethatisdueonanydayonwhich the Officeis closedfor business shallbe acceptedas properly filedifitis receivedonthenextdaythattheOfficeisopenfor business.
2. Ifheis satisfiedthatmailtoorfromtheOfficewassentbutnever received, the Registrar may accept or send out replacing correspondence; andthe effectivedateofthe replacing correspondenceisthedatethatthe

3. When,byan affidavit setting forththe relevant facts,the Registraris satisfiedthatanytimefixedbytheseRulesforthedoingofanything shouldbe extendedinaparticular case,the Registrarmay,either beforeor afterthe expirationofthetime,extenditforsuchperiodashethinks suitableinthe circumstances.

Clerical errors

1. The Registrarmay,bythe issuanceofhis certificate, correct,inrespect ofaregisteredmark,anyerrorintheregisterthatisofaclericalnatureandthat wouldnotinhisopinionmakeanychangeintherightsofthe registered owner or registered licenseeofthe mark.
2. WherenoprovisionismadeintheActortheseRulesinrespectofany matterarisinginthe administrationoftheAct,the Registrarmaygivesuch directionsinrespect thereofasheconsiders necessaryinthe circumstances.
3. (1) The Registrarmaygiveacertificate regardinganyentry,matter orthingthatheis authorizedorrequiredbytheActortheseRulestomakeor do.

62. TheRegistrarmayacknowledgeinquiriesmadetotheOffice,butthe ^{Inquiriesmade} to Office.
