Notes
The notification by Switzerland to the WTO under Article 63.2 of TRIPS states:
'This law replaces the Federal Law on Cartels and Similar Organizations of December 20, 1985 and specifically deals with matters related to anti-competitive practices.
It contains specific provisions that regulate the relationship between cartel law and intellectual property law.
Article 3(2) provides that acts of which the effects on competition arising exclusively from the legislation on intellectual property will not fall within the scope of the Law on Cartels.
Article 6(1)(d) refers to agreements on the granting of exclusive licenses relating to intellectual property rights, which are considered to be justified.
Chapters 3 and 4 of the law set out the civil law and administrative proceedings and penalties for anti-competitive practices.'
This consolidated version of the law includes the amendments, which are not related to the provisions on intellectual property.
Dates of entry into force: July 1, 1996 and Art. 18 to 25, February 1, 1996.
