The notification by Switzerland to the WTO under Article 63.2 of TRIPS states:
'This law replaces the Federal Law on Cartels and Similar Organizations of December 20, 1985, and specifically deals with matters related to anti-competitive practices.
It contains specific provisions that regulate the relationship between cartel law and intellectual property law.
Article 3(2) provides that the effects of acts on competition arising exclusively from the legislation on intellectual property will not fall within the scope of the Law on Cartels.
Article 6(1)(d) refers to agreements on the granting of exclusive licenses relating to intellectual property rights, which are considered to be justified.
Chapters 3 and 4 of the law set out the civil law and administrative proceedings and penalties for anti-competitive practices.'
