Year of Version 2016 Dates Status as of: October 6, 2016 Amended up to: December 1, 2015 Entry into force: March 1, 2004 Adopted: March 14, 2003 Type of Text IP-related Laws   Subject Matter Patents (Inventions) Subject Matter (secondary) IP Regulatory Body Notes This consolidated version of the "Act of March 14, 2003, on the Filing of European Patent Applications and the Effects of European Patents in the Republic of Poland" takes into account amendments up to "Act of July 24, 2015, on Amendments to Act on Industrial Property Law and Certain Other Acts", which entered into force on December 1, 2015. Article 4 of the said amending Act introduced amendments to the following provisions of this consolidated version: 1) In Article 3, section 2 is replaced by the following: “2. European patent applications filed through the Patent Office by the persons mentioned in Article 40 of the Act on Industrial property Rights are drawn up in Polish or accompanied by a translation into Polish language."; 2) In Article 6, section 3 is replaced by the following: “3. The provision of section 2 shall apply mutatis mutandis if, as a result of consideration of the opposition by the European Patent Office, the European patents will be amended or limited at the request of the rightholder.". By means of the the announcement of the Marshal of the Sejm of the Republic of Poland of December 16, 2015, the said consolidated version of the Act of March 14, 2003, was published on April 1, 2016, in the Journal of Laws 2016, item 2 and was updated on October 10, 2016.
