Year of Version 2006 Dates Assented: March 16, 1998 Commenced: March 16, 1998 Type of Text IP-related Laws Subject Matter Trademarks, Trade Names Notes The Pesticides (Control) Act [Cap. 226] is contained in the Laws of the Republic of Vanuatu - Consolidated Edition 2006. This Act makes provisions for the regulation and control of the importation, manufacture, sale, distribution and use of pesticides, and for matters connected therewith. In particular, refer to the IP-related provisions as follows: Section 8 - Prohibition on importation, manufacture, formulation, use, distribution, etc., of pesticides (an approved container or approved package and an approved label are some of the criteria that must be satisfied in the manfacture/import process) (see page 6) Section 10 - Application for registration or for permit to import (information needed for registration: subsection 3 (c) - trade name of the pesticide; subsection 3 (e)- a copy of the draft label or package (see page 7) Section 16 - Label to be approved before registration (see page 9) Section 17 - Register of pesticide (trade names of every pesticide registered) (see page 10) Section 19 - Alteration in package or composition (prohibition on alteration in package, label or composition of a pesticide by the holder of certificate) (see page 10) Section 27 - Advertisement of pesticides (prohibition on false, misleading or deceptive advertising) (see page 13)
