Pursuant Article 8 paragraph (3) and Article 14 paragraph (9) of the Law on Customs Measures for Protection of Intellectual Property Rights ("Official Gazette of the Republic of Macedonia" No. 88/15), the Minister of finance hereby adopts

RULEBOOK ON THE FORM AND CONTENTS OF THE APPLICATlON FORM FOR ACTION BY CUSTOMS AUTHORITIES AND RELATED ·

REQUIRED DOCUMENTATION AND OF THE APPLICATION FORM FOR EXTENSION OF THE PERIOD FOR ACTION BY CUSTOMS AUTHORITY

Article 1
This Rulebook shall prescribe the form and content of the Application form for action by customs authority and related required documentation and of .the Application form for extension of the period for action by the customs authority.
Article 2
The Application form for . by..customs authority shall submitted by us.ing the prescribed form, on A4 size white sheet ofpa er. •·
The form and the content of the ·Application form of paragraph 1 of t is Article are presented in Appendix 1, which is a constituent part of this Rulebook.
Article 3 .
The Application referred to in Article 2 paragraph 1 of this Rulebook ·sha ll be accompanied by the following documents:

(1) Proof of registration with a competent authority or proof acknowledging that the

application is submitted for industrial property right which is registered. Excerpt of registration from the database of a foreign or domestic competent authority may be considered as proof. Additional proof acknowledging that the holder of the right is a producer or group of producers, as well as proof confirming that mark of origin of the product or geographic mark is registered shall be provided for protected marks of or'igin of a product and protected geographic marks.
(2) Proof for copyright or fpr the status of the applicant as a primary holder, for the

copyright or related right that is not registered or for which no application has been submitted.

In addition to one of the required proofs referred to in paragraph 1 of this Article, documents concerning the acquired right to use the right in question shall be also enclosed to the application when the application is lodged by other nationctl or for ign legal entity or natural person having right to use some of the intellectual property rights. ·

Article 4

The Application- for extension of the period for action by customs authority shall be submitted by using the prescribed form, on A4 size white sheet·ofpaper.

The form and the contents of the Application of the paragraph 1 of this Article are

presented in Appendix 2, which is a constftuent part of this Rulebook.

Article 5

The forms referred to in Article 2 paragraph 1 and Article 4 paragraph 1 of this Rulebook shall be completed in. print handwriting in ink or electronically, without erasing or crossing out words r any other modifications. The forms shall be _submitted in two copies.

Article 6

By entering into force of this Rulebook the Rulebook on implementation of the Law on Customs "Measure for Protection of Intellectual Property Rights ("Offi ial Gazette of the Republic of Macedonia" no. 58/05, 82/11 and 132/13) will be abolished.

With tQe entry into force of this Rulebook, the ulebook on implementation of the Law on Customs Measure for Protection of Intellectual Property Rights ("Official Gazette of the Republic of Macedonia" no. 58/05, 82/11 and 132/13) shall. cease to be valid.

Article 7

This Rulebook shall enter into force on the day following that of its publication in the "Official

Gazette of the Republic of Macedonia".
