This consolidated version of Law No. 20.169, which is in force from February 3, 2010 incorporates amendments introduced by Article Twelfth, paragraph No. 5 of Law No. 20.416 (for the amendments see Article 4, letters h and i of the consolidated version).
The Amendment Law No. 20.416 was promulgated on January 13, 2010, was published in the Official Gazette and came into force on February 3, 2010. It was amended on October 10, 2014; however there are no amendments to the said Article Twelfth, paragraph No. 5.
The consolidated Law contains regulations relating to the scope, enforcement and/or prevention of abuse of intellectual property rights, penalizing acts of unfair competition, and it is expressly stipulated that it applies to industrial and intellectual property rights regulated under Laws No. 17.336 and No. 19.039.
Article 4, letters a) to c) under Chapter II of this consolidated Law contains provisions on acts of unfair competition related to IP, including the misuse of the distinctive signs of a third party and false information on goods and services of a third party that could undermine its reputation in the market.
