This Law amends the title of Part 4 of the Civil Code from “Copyrights” to “Legislation on Intellectual Property”, and its substantial content, which covers all areas of intellectual property, including copyright and related rights, inventions, industrial designs, semiconductor topographies, selection achievements, trademarks and commercial names.
The amended version of Part 4 contains Articles 1052 to 1069 divided into 5 sections: general provisions (Section 1, Articles 1052-1055); exclusive rights (Section 2, Articles 1056-1061); license agreements (Section 3, Articles 1062-1064); collective rights management (Section 4, Article 165); and protection of intellectual rights (Section 5, Articles 1066 to 1069).
The amendments have affected, inter alia, the intellectual property license agreements. A natural or legal person holding the exclusive right to a result of intellectual activity or to a means of individualization (the right holder) shall have right to use this result or this means at his own discretion in a lawful manner (Article 1056(1)); and a licensing agreement should include the subject of the agreement and the procedure for using the result of intellectual activity or means of individualization (Section 2, Articles 1062(3)). In cases provided for by the Civil Code of Turkmenistan, a court may, at the request of an interested person, makes a decision to grant this person, the rights to use a result of intellectual activity, the exclusive rights of which belongs to another person (a compulsory license) (Section 2, Article 1064) .
