Madrid Agreement Concerning the International Registration of Marks

Accession by the Republic of Cuba

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the deposit by the Government of the Republic of Cuba, on September 6, 1989, of its instrument of accession to the Madrid Agreement Concerning the International Registration of Marks of April 14, 1891, as revised at Stockholm on July 14, 1967.

The said instrument of accession contains the following declaration:

"The Government of the Republic of Cuba declares that the provisions of Article 24 of the Paris Convention, referred to in Article 14(7) of the Madrid Agreement, both as revised at Stockholm on July 14, 1967, are contrary to the Declaration on the Granting of Independence to Colonial Countries and Peoples (resolution 1514) adopted by the General Assembly of the United Nations on December 14, 1960, which proclaims the necessity of putting a speedy and unconditional end to colonialism in all its forms and manifestations," (Translation)

The Government of the Republic of Cuba has also notified the Director General of WIPO that Cuba avails itself of the possibility offered by Article 3bis of the Madrid Agreement, according to which the protection resulting from the international registration shall extend to Cuba only at the express request of the proprietor of the mark. Furthermore, in accordance with Article 14(2)(d) and (f) of the Madrid Agreement, the application of that Agreement shall be limited to marks registered from the date on which the accession of Cuba enters into force.

The Republic of Cuba has not heretofore been a member of the Union for the International Registration of Marks ("Madrid Union"), founded by the Madrid Agreement.

The Madrid Agreement, as revised at Stockholm on July 14, 1967 and amended on October 2, 1979, will enter into force, with respect to the Republic of Cuba, three months after the date of this notification, that is, on December 6, 1989. On that date, the Republic of Cuba will become a member of the Madrid Union.
