Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Notification of the European Patent Organisation (EPO) of a Change in Fees Charged by the Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH (DSM)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the receipt, on February 13, 1990, of the notification of the European Patent Organisation (EPO), dated February 6, 1990, stating a change in the fees charged by the Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH (DSM), an international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, as amended on September 26, 1980 (see Budapest Notification No. 22 of August 27, 1981). The schedule of fees, as changed, is attached.

The fees set forth in the said notification will apply as from the thirtieth day following the date (March 31, 1990) of the publication of the said fees in the March 1990 issue of Industrial Property/La Propriété industrielle, that is, as from April 30, 1990 (see Rule 12.2(c) of the Regulations under the Budapest Treaty). The said fees will replace the fees as published in the April 1988 issue of Industrial Property/La Propriété industrielle (see Budapest Notification No. 69 of April 5, 1988).

SCHEDULE OF FEES

The schedule of fees has been amended as follows:

      DEM
1. a) Storage according to the Budapest Treaty [Rule 12.1.a)i)] 1,100
  b) Conversion of a deposit made outside the Budapest Treaty into a deposit according to the Budapest Treaty [1] 1,100
  c) Prolongation of the duration of the storage over the one provided by Rule 9 of the Budapest Treaty, per year 36
2. Issuance of a viability statement [Rule 12.1.a)iii) of the Budapest Treaty]  
  a) Where a viability test is also requested 100
  b) On the basis of the last viability test 40
3. Furnishing of a sample [Rule 12.1.a)iv) of the Budapest Treaty] 100
4. Communication of information under Rule 7.6 of the Budapest Treaty 40
5. Attestation referred to in Rule 8.2 of the Budapest Treaty 40

As a general rule the fees under 1, 2, 4 and 5 are subject to VAT, currently 7%. Where samples are furnished, VAT is payable only by requesting parties in the Federal Republic of Germany.
