Further to the approval to work on a WIPO HCCH Guide on Intellectual Property and Private International Law with the Honorable Dr. Annabelle Bennett, former Judge of the Federal Court of Australia, and the Honorable Mr. Sam Granata, Judge of the Court of Appeal of Antwerp, Belgium, the two authors have submitted their respective drafts and the draft Guide is being advanced with input from the HCCH and WIPO.
2. In order to facilitate the finalization of the draft Guide, scheduled to be presented at the twelfth session of the Advisory Committee on Enforcement (ACE), and using the opportunity of Dr. Bennett being in Brussels at the end of June, it is proposed to organize a meeting in Brussels on June 28, 2017. The meeting would be attended by Dr. Bennett, Judge Granata, Ms. Marta Pertegás, First Secretary, HCCH, Ms. Ning Zhao, Senior Legal Officer, HCCH, and myself. A face to face meeting is deemed necessary as addressing the divergent subtleties in the intersection between intellectual property and private international law arising from the civil and common law legal traditions addressed in the draft Guide would be greatly enhanced by discussing the complex issues directly rather than through exchange of emails and drafts. |
