1. Upon request of the Government of Cambodia, the Patent Law Division (PLD), Legislative and Policy Advice Section of the World Intellectual Property Organization (WIPO) is working on some comments to the Draft Law on Undisclosed Information, Compulsory Licensing for Public Health and Trade Secrets which will be finalized shortly.
2. The Building Respect for IP Division of WIPO also provided some comments on the part on enforcement contained in such Draft. These inputs will be included in the final document to be consolidated by the PLD.
3. The Cambodian Authorities are particularly in need to finalize the reform of the legislation in the area of undisclosed information, and asked WIPO, with email dated September 24, 2018, for assistance in the organization of some consultations with WIPO officials and the Cambodian drafters.
4. In order to assist the Government of Cambodia in the understanding of the comments that will be delivered to them in the next weeks, I suggest giving a positive reply and organizing a two-day meeting in Geneva from December 12 to 13, 2018.
5. The program (attached) is aimed to shed light on certain undisclosed information related issues contained in the Draft, having in mind the international legal framework and Cambodian public policies.
6. The following three delegates from Phnom Penh, Cambodia, would take part to the meeting:
a. Mr. Lao Reasey, Deputy Director of DIP, in charge of Legal Affairs and International Cooperation, Trade Secret and Geographical Indications;
b. Mr. Sok Hong, Chief Division of Trade Secret and Geographical Indication, DIP; and
c. Mr. Chhay Hong, Deputy Chief of Litigation Bureau, DIP.
7. This activity would be financed by Program 0105_W10857. Cost estimate is attached.
