NEW Updated Dispute Service for .PH (Philippines)

WIPO has collaborated with PH Domain Foundation (the .PH Registry) to provide dispute resolution services for .PH domain names for the past 25 years.

The .PH dispute Policy is a variation of the UDRP:

  • The procedure does not require the parties to send hard copies of their pleadings and annexes anymore
  • Under UDRP paragraph 4(c)(iii) a domain name registrant may not claim rights or legitimate interests if the registrant uses the domain “to tarnish the trademark or service mark at issue.”  Such clause does not appear in the .PH dispute Policy
  • The Mutual Jurisdiction for domain name disputes is a court jurisdiction at the location of either (a) the Hong Kong, China or (b) the domain-name holder's address
  • The .PH Registry will implement a panel decision to transfer or cancel a domain name after 30 business days (as opposed to 10 business days under the UDRP), if the .PH Registry does not receive documentation from one of the parties regarding a court proceeding.

Please find the updated .PH model complaint and response, and note that a “lock” provision has been added to the .PH Rules to prevent cyberflight issues.
