PCT Information Update

AP  African Regional Intellectual Property Organization (ARIPO) (telephone and fax numbers; e-mail addresses; means of telecommunication)

The telephone and fax numbers of the African Regional Intellectual Property Organization (ARIPO) have changed, and the Office has notified an additional e-mail address.  The numbers and e-mail addresses to be used are now as follows:

There has been a change to one of the telephone numbers of the Canadian Intellectual Property Office.  The numbers to be used are now as follows:

CU  Cuba (fees)

The fee for priority document, payable to the Cuban Industrial Property Office as receiving Office, may now also be paid in the equivalent amount in Cuban pesos (CUP) of 100 Cuban convertible pesos (CUC).

EC  Ecuador (fees)

The Ecuadorian Institute of Intellectual Property has notified the IB of the amount of the transmittal fee, payable to it as receiving Office.  The amount payable is USD 300.

IB  International Bureau (means of filing the international application;  fees)

It is recalled that the new Contingency Upload Service, a secure service for the electronic transmission of documents to the International Bureau (IB), has been available since the end of 2018.  The service offers an alternative filing means in the unlikely event that ePCT is unavailable for technical reasons, and also in the event that other means of communication with the IB are, from the perspective of the applicant, not desirable or eventually no longer available (such as fax services). 

In the event that the Contingency Upload Service is used to file a new international application with the IB as receiving Office, the applicant will receive a fee reduction of 100 Swiss francs for an electronic filing according to item 4(a) of the PCT Schedule of FeesFee Table I(a) has been updated to include this amount, as well as the equivalent amounts in euro and US dollars.

Note that this new service has been developed primarily as a contingency measure in the event that the applicant needs to submit a document to the IB urgently, and the ePCT System is not available or the applicant does not yet use ePCT.  Applicants are strongly encouraged to use ePCT whenever possible.  By doing this, the applicant will benefit, in particular, from pre‑filled bibliographic data, where applicable, and the many business validations built into the system.

The telephone numbers of the Korean Intellectual Property Office (KIPO) have changed, as follows:

KIPO, in its capacity as designated (or elected) Office, has notified a change in the conditions for obtaining a reduction in certain national fees, as follows:  the filing fee, fee for request for examination, annual fees from the first to the third year and fee for request for scope confirmation trial are reduced by 70% where the applicant is a natural person and is also the inventor.  However, if the number of applications filed by the applicant exceeds 20 per year, the filing fee will be reduced by only 30%.  Furthermore, the fee for request for examination is reduced by 30% where the international search report (ISR) or international preliminary examination report (IPER) has been established by KIPO, or by 70% where the ISR and IPER have been established by KIPO.

The Office has informed the International Bureau (IB) that, with effect from 1 April 2019, it will no longer send notifications via e-mail in respect of international applications.

Furthermore, the Office as designated (or elected) Office has notified a change in the conditions for reductions in national fees.  While the examination fee continues to be reduced by 50% where the international search report (ISR) has been established by the Office, it is reduced by 10% where the ISR has been established by any of the other International Searching Authorities (ISAs).

As from 1 June 2019, there will be changes in the equivalent amounts payable in the currencies specified below for international searches carried out by the following Offices:

The above-mentioned changes are indicated in Fee Table I(b).

The European Patent Office (EPO) has notified changes to the conditions for refund of the search fee in respect of ISRs drawn up on or after 1 April 2019:  where the ISR drawn up by the EPO as ISA is based on an earlier search report prepared by the Office on an application, the priority of which is claimed in the international application – there is now a full or partial refund of the international search fee paid for a pending international application where the ISR is based on an earlier search made on behalf of the United Kingdom on a national application filed as of 1 July 2018.
