PCT Information Update

International filing fee, search fee, supplementary search fee and handling fee (various Offices)

On 1 January 2019, there will be changes in the equivalent amounts, in certain currencies, of the international filing fee, the fee per sheet over 30, the electronic filing reductions (where applicable) listed in item 4 of the Schedule of Fees, the search fee, the supplementary search fee and the handling fee, as indicated in the PCT Fee Tables.

These changes will be reflected in the following annexes of the PCT Applicant’s Guide (www.wipo.int/pct/guide/en/):

BH  Bahrain (telephone numbers; e-mail address)

One of the telephone numbers and the e‑mail address of the National Patent Office (Bahrain) have changed.  The telephone numbers and the e‑mail address to be used are now as follows:

BY  Belarus (special requirements for entry into the national phase; fees)

The National Center of Intellectual Property (Belarus) as designated (or elected) Office has changed one of its requirements under PCT Rule 51bis for entry into the national phase – the translation of the international application should now be furnished in two copies instead of three.

Furthermore, the amounts of the following national fees, payable to the Office as designated (or elected) Office have changed:

CR  Costa Rica (e-mail address; electronic filing; fees; special requirements for entry into the national phase)

The Registry of Industrial Property (Costa Rica) has notified an additional e‑mail address.  The e-mail addresses to be used are now as follows:

For information on the acceptance, with effect from 1 December 2018, by the Office as receiving Office of international applications filed using ePCT‑Filing, as well as information on the electronic filing fee reductions listed in item 4 of the Schedule of Fees that will be applicable, go to “Electronic Filing and Processing of International Applications”.

The Office, in its capacity as designated (or elected) Office, has notified a change in the conditions for exemptions, reductions or refunds of national fees.  It is possible to reuse the national fee already paid for an application that was subsequently abandoned for the payment of the national fee in respect of a new application with the same subject matter.

Furthermore, the Office clarified one of its special requirements under PCT Rule 51bis — the translation of the international application or any document relating to it should be furnished in two copies (one paper copy and an additional copy in electronic format (CD-ROM)).

DO  Dominican Republic (number of copies required; fees)

The National Office of Industrial Property (Dominican Republic) as receiving Office has notified the International Bureau (IB) that it requires four copies of the international application on paper, instead of three. 

The amounts of the following national fees, payable to the Office as designated (or elected) Office have changed:

NZ  New Zealand (means of telecommunication; who can act as agent; special provisions concerning the deposit of microorganisms and other biological material)

The Intellectual Property Office of New Zealand (IPONZ) has notified the IB that it accepts the filing of documents via the Office’s online case management facility.  Also, the Office now sends notifications via e‑mail in respect of international applications.

It is recalled that any person registered to practice before the IPONZ as a patent attorney can act as agent.  The list of registered patent attorneys is now available from the Trans-Tasman IP Attorneys Board at:  https://www.ttipattorney.gov.au/

Furthermore, the Office has notified its requirements concerning the deposit of microorganisms and other biological material, as indicated in the PCT Applicant’s Guide, Annex L at:
