Collaborative Search and Examination Pilot

It is recalled that PCT Newsletter No. 07-08/2018 gave details of a Collaborative Search and Examination (CS&E) pilot, whereby the IP5 Offices1, upon the applicant’s specific request to participate, all contribute towards the international search report and the written opinion of the International Searching Authority (ISA) for a particular international application.  Each participating IP5 Office may process around 50 international applications as main ISA during the first year (July 2018 to June 2019) and a similar quantity in the second year (July 2019 to June 2020).

European Patent Office (EPO)

It was announced in PCT Newsletter No. 09/2018 that, since the EPO had already accepted over 40 applications in English in the pilot for this year, it would like to complete this year’s quota with about 10 international applications in French and German.  The EPO has now confirmed that, as main ISA, it will start accepting international applications filed in French or German as of 1 January 2019.  Note that where such an application has been provisionally accepted for the pilot project, an English translation of the application must be submitted within one month of the date of notification of the provisional acceptance.  Further information is available in the Official Journal of the EPO, issue No. 11/2018, at: 


China National Intellectual Property Administration (CNIPA)

CNIPA has also announced that it has accepted over 40 applications in English and will thus not accept further English language applications for the moment.  It is expected that applications in Chinese will be accepted from early 2019.  Further information (in Chinese only) is available at:


United States Patent and Trademark Office (USPTO)

The USPTO is also approaching its target of 50 applications to be accepted during the first year.
