Survey Of Numbering Systems Used, Or Intended To Be Used, By Industrial Property Offices for Published Documents And Registered Rights

Draft prepared by the International Bureau for consideration by CWS/8

Introduction

  1. This Survey covers numbering systems for patents for inventions, plant patents, design patents, utility models, supplementary protection certificates (SPCs), industrial designs, topographies of integrated circuits and trademarks, mainly since 1970.

  2. The Survey consists of one table, which gives examples of publication and registration numbers, including explanations of their form or presentation.

  3. References to the following Standards are relevant to this Survey:

  4. It should be noted that the Benelux Trademark and Designs Offices have replaced the national Offices of Belgium, Luxembourg and the Netherlands for industrial designs and trademarks.

  5. For further information regarding numbering systems, please refer to the following:

    • Numbering of applications and priority applications - current practices (Part 7.2.6)
    • Numbering of applications and priority applications - former practices (Part 7.2.7)
    • Summary regarding numbering systems and date formats introduced or planned to be applied with regard to the arrival of the year 2000 (Part 7.2.3)
    • Survey on the presentation of priority application numbers (Part 7.2.4)

Before 27 June 1997, the patent system in the Hong Kong Special Administrative Region ("HKSAR") was based on the Registration of Patents Ordinance (Chapter 42 of the Laws of Hong Kong) ("Cap. 42"). That system was essentially a re-registration system based on a first registration taking affect in the UK. This application number applies to the patents which were granted under Cap.42 and other relevant patents granted under the UK Patents Act 1949 or 1977 during the transitional period after that date (collectively "deemed standard patents"). It consists of two-digit year of filing, a digit 0, and a five-digit serial number. The digit 0 indicates deemed standard patents. Since 27 June 1997, the Patents Ordinance (Cap. 514) ("Cap. 514") have come into force and there are two types of patents, namely, standard patent which is based on one of the patents granted by CNIPA, EPO (designating UK) or UKIPO ("standard patent by re-registration") and short-term patent which is mainly based on formality examination. The patentability requirements for standard patent by registration and short-term patent are the same whereas the terms of protection for them are 20 years and 8 years respectively. Since 19 December 2019 when the amended Cap. 514 has come into force, there is an additional type of standard patent i.e. standard patent (O) where substantive examination of the application concerned is conducted by the Registrar of Patents of HKSAR and the standard patent by re-registration is named as standard patent (R).
