Overview

With the advent of globalization, international research collaborations and technology transfers have increased among public and private research institutions, universities, companies, start-up firms, venture capitalists and other entities involved in the commercialization of research. These transactions involve immensely valuable intellectual property rights (IPRs) - patents, trademarks, copyrights, trade secrets and other forms of IPRs, which are increasingly the subject of disputes among concerned parties. The litigation of such disputes may implicate several legal systems because IPRs are protected on a territorial basis, and a national court typically only entertains disputes over rights recognized in its own jurisdiction. In multiparty disputes, this would necessitate simultaneous suits in several foreign jurisdictions with the associated delays, increased costs, inadequate legal facilities, potential partiality and lack of secrecy for sensitive IPRs. Carefully incorporating alternative dispute resolution (ADR) strategies to address these complex problems would help protect the value of technologies and related IPRs generated from international research collaborations, in a speedy and cost-efficient manner, while also preserving cordial relationships.

The Conference will bring together a wide range of stakeholders – technology transfer offices and professionals, corporate consultants, lawyers, legal advisers, IP owners, project managers and researchers – to discuss the likely causes of IP disputes in international technology transactions, and to explore various ADR options for handling them. Speakers from WIPO, MyIPO, law offices, industry, university departments and other institutions versed in research collaborations and technology transfers will share their experiences in managing collaborations, spotlight areas of potential disputes and their dispute resolution strategies.
