WIPO Arbitration Workshop - the Faculty

She is Vice-President of the ICC International Court of Arbitration, appointed in 2009, as well as Vice President of the International Council of Commercial Arbitration (ICCA), and Vice Chairperson of Hong Kong International Arbitration Centre (HKIAC). She is a member of the International Centre for Settlement of Investment Disputes (ICSID) panel of Arbitrators, designated by the Chairman of the ICSID Administrative Council. She was Past President of the Chartered Institute of Arbitrators (CIArb), and a past Chairman of its East Asia Branch. She is also Council Member of China International Economic and Trade Arbitration Committee (CIETAC); a Councilor of Asia Pacific Users’ Council of the London Court of International Arbitration (LCIA) and a panel arbitrator of Court of Arbitration for Sport (CAS). She also sits as a Deputy Judge in the Court of First Instance of the High Court of Hong Kong.

Ms Cheng is a Fellow of King’s College, London, and Visiting Professor of the School of Law of Tsinghua University, Beijing, Adjunct Professor in the University of Hong Kong, and Hong Kong Polytechnic University. Ms Cheng has co-authored numerous books and articles in journals and seminars. Some of her recent publications include “Construction Law and Practice in Hong Kong” and “Arbitration in Hong Kong: A Practical Guide”, published by Sweet & Maxwell, as well as papers in the “International Council for Commercial Arbitration Congress Series”, published by Kluwer Law International.

Trevor COOK, a national of the United Kingdom, is a partner with Bird & Bird in London. He is a member of the firm’s Intellectual Property Group. Mr. Cook is a solicitor and holds a degree in chemistry from the University of Southampton.

Mr. Cook has extensive experience in multi-jurisdiction patent litigation. He is on the WIPO List of Arbitrators and has acted as counsel and arbitrator in various arbitration cases. He has recently acted as arbitrator in a complex international WIPO patent arbitration.

Mr. Cook is the President of the UK Group of the International Association for the Protection of Industrial Property (AIPPI), Secretary to the British Copyright Council Working Group on Copyright and Technology, and a member of the Council of the Intellectual Property Institute.

In addition to numerous articles, Mr. Cook has authored several books, especially on patent issues, in particular The Protection of Regulatory Data in the Pharmaceutical and Other Sectors (Sweet & Maxwell 2000), A User’s Guide to Patents (Butterworths 2002, Tottel 2006, Bloomsbury 2011), Pharmaceuticals Biotechnology and the Law (Macmillan 1991, LexisNexis Butterworths 2009), EU Intellectual Property Law (Oxford University Press 2010) and co-author (with Alejandro Garcia) International Intellectual Property Arbitration (Wolters Kluwer 2010).

David PERKINS, a national of the United Kingdom, is a partner in Arnold & Porter (UK), LLP’s intellectual property practice in London. Prior to joining the firm, he served in major leadership positions in the intellectual property practice area at international law firms. He was a partner at Clifford Chance from 1975 to 2003 in which he headed its European intellectual property litigation practice and subsequently at Milbank Tweed’s London office from 2003 to 2009.

Mr. Perkins concentrates his practice on multijurisdictional patent litigation, as well as trademark and antitrust issues. He also handles oppositions and appeals before the European Patent Office in Munich and references to the European Court of Justice (ECJ) in Luxembourg. He also acts as counsel and arbitrator in numerous arbitrations involving intellectual property rights.

Mr. Perkins is also an Arbitrator and Mediator for the World Intellectual Property Organization’s Domain Name Dispute Resolution Service. He has had significant involvement in advising in relation to both mediation and arbitration of multi-jurisdictional disputes involving intellectual property rights.

Mr. Perkins is a member of several professional bodies including the Law Society, the International Bar Association (IBA), and the European Communities Trade Mark Association (ECTA), the International Association for the Protection of Intellectual Property (AIPPI) and an Associate Member of the Chartered Institute of Patent Agents (CIPA). He is a foreign member of the American Bar Association (ABA) and the American Intellectual Property Law Association (AIPLA). He is a Council Member of the Intellectual Property Institute (IPI), and of the Intellectual Property Lawyers Organisation (TIPLO), of which he is also a founding member. He is a member of the Executive Committee of the European Union of Intellectual Property Practitioners (UNION) and a Council Member of the British Group of UNION. He also served as a member of the UK Government's Intellectual Property Advisory Committee (IPAC) from August 2001 to April 2002.

Mr. Perkins has written over 50 publications. He studied Law at Newcastle University.

Lucy F. REED, a national of the United States of America, is a Partner with Freshfields Bruckhaus Deringer LLP in Hong Kong. She is co-head of the Freshfields Global International Arbitration Group.

A specialist in international commercial arbitration, Ms. Reed advises private and public clients and serves as arbitrator in arbitrations under the major institutional and ad hoc rules. She is also an arbitrator on the Eritrea-Ethiopia Claims Commission, and served as a co-director of the Claims Resolution Tribunal for Dormant Accounts in Switzerland. She has written and lectured extensively on international arbitration, and is a co-author of The Freshfields Guide to Arbitration and ADR: Clauses in International Contracts, and Guide to ICSID Arbitration (both published by Kluwer).

She was the first general counsel of the Korean Peninsula Energy Development Organization. She was with the US State Department as the US agent to the Iran-US Claims Tribunal, and Deputy Assistant Legal Adviser for International Claims and Investment Disputes.

Ms. Reed is Chair for the Institute of Transnational Arbitration, immediate past President of the American Society of International law, and a member of the Council on Foreign Relations.

Ms. Reed received her BA from Brown University in 1974 and her law degree from the University of Chicago Law School in 1977, where she was a member of the Law Review.

Her recent experience includes representing: ConocoPhillips in its ICSID case against the Government of Venezuela; the Government of Turkey in three Energy Charter Treaty cases; an Asian government entity in ICC arbitrations involving a disputed share purchase agreement; a US energy company in LCIA arbitrations based on political risk insurance claims; CMS Energy in the first ICSID arbitration against Argentina to succeed on the merits and jurisdiction; and Japanese companies in arbitrations of licensing disputes.

Richard TAN, a national of Singapore, is a senior international arbitration consultant at Stamford Law Corporation, Singapore. He currently practises primarily as an arbitrator. He has been in legal practice for more than 32 years. He was the former head of the Lovells (now known as Hogan Lovells) South Asian international arbitration practice group and before that, a senior partner at Lee & Lee where he headed the firm’s arbitration practice group and the intellectual property and technology department.

He practices in the areas of international arbitration, construction, commercial, energy, joint ventures, shareholders disputes, corporate, information technology, intellectual property, media and entertainment.

He was admitted to practice law in Singapore in 1980 and is also qualified to practice in England and Wales. He is a Chartered Arbitrator of the Chartered Institute of Arbitrators and a Fellow of the Singapore Institute of Arbitrators.

Mr. Tan is the current Chairman of the Chartered Institute of Arbitrators Singapore Branch. He is a past president of the Singapore Institute of Arbitrators and has served on the board of the Singapore International Arbitration Centre. He is on the arbitration panels of many regional and international arbitral bodies including the WIPO Arbitration and Mediation Center, SIAC, HKIAC, BANI, KLRCA, AAA/ICDR, the Law Society, Singapore Institute of Arbitrators and the Chartered Institute of Arbitrators. He is also on the SIAC panel of arbitrators for emergency relief (Emergency Arbitrator panel). He is also on the WIPO Arbitration and Mediation Center panels for Domain Name disputes and Film and Media disputes and the SMC panel for Singapore domain name disputes.

He is an adjunct associate professor at the National University of Singapore and has taught on the joint NUS-Kings College MSc programme on construction and arbitration law. He has been an advisory board member of UNCTAD on dispute resolution and on a task force of the National Research Foundation on digital media. He has been a Vice-President of the AIPPI (Singapore Group). He is a board member of the Singapore Film Commission.

Mr. Tan has acted as arbitrator and counsel in many international arbitrations under the SIAC, ICC, HKIAC, LCIA and other institutional rules as well as in ad hoc arbitrations under the UNCITRAL arbitration rules, involving a wide range of disputes including major construction and engineering disputes (including an airport, tunnel, oil platforms, power projects and pharmaceutical plants), commercial disputes (including joint venture and shareholders agreements) and technology, media, intellectual property and licensing disputes.

Mr. Tan lectures frequently on arbitration. He is also on the approved faculty of the Chartered Institute of Arbitrators (UK) and has been course director and lecturer on many arbitration courses. He has also written many articles on a variety of subjects. He has been recognised as an expert and a leading individual in the field of arbitration by many of the leading legal directories.
