Mediation for industrial property cases referred by the European Union Trademark Court in Spain

In 2025, the European Union Trademark Court in Spain based in Alicante (Trademark Court), established a collaboration with the WIPO Arbitration and Mediation Center (WIPO AMC), to offer to parties involved in a dispute pending before the Trademark Court the possibility to use WIPO Mediation.

List of WIPO Specialized Mediators

The effectiveness of the proceedings depends largely on the quality of the mediator. The WIPO AMC has established a specific list of mediators accredited before the Spanish Ministry of Justice specializing in industrial property, who are experts in the disputed matters before the Trademark Court.

How to submit a dispute to WIPO mediation?

The Trademark Court, in accordance with Article 16.3 of Law 5/2012, will invite the parties to a mediation briefing with a WIPO mediator to consider resolving the dispute through mediation, in accordance with the WIPO Mediation Rules.

What are the specific advantages of mediation by WIPO mediators?

WIPO mediators are experts in the mediation procedure, as well as in industrial property and related matters (licensing, distribution contracts, unfair competition, etc.). WIPO mediators are therefore trained to assist the parties in reaching an effective and win-win solution.

It is a flexible procedure where the WIPO AMC provides a confidential and effective framework, through online tools.

How much does WIPO mediation cost?

In accordance with the collaboration between the Trademark Court and the WIPO Center, preferential rates are applied, resulting in a reduction in the fees of the WIPO mediator and waiver of the WIPO administration fee, to cases referred by the Trademark Court.

    1. After consultation with the parties and the mediator, the WIPO AMC shall determine the final amount to be paid to the mediator, considering the preferential rates indicated above and the complexity of the subject matter of the dispute. In no case shall the mediator's fees exceed the total amount of EUR 4,500.
    2. The first information session is free of charge, so that no fees will be due to the mediator in case mediation does not proceed after the information meeting.
    3. A 40% discount on the mediator's fees will be applied in cases where one (or more) party(ies) is an SME (an entity with less than 250 employees), startup or self-employed.
