 Decision on the Amount of the Single Equitable Remuneration of Copying in Private Use

On the base of Article 48 paragraph (1) of the Law on Copyright and Related Rights

("Official Gazette" no. 115/10 and 51/11), the Government of the Republic of Macedonia

on its Session held on 22.10.2011 adopted a

DECISION

on the amount of the single equitable remuneration of copying for private use*

Article 1

This Decision shall establish the amount of the single equitable remuneration of copying

for private use of literary works, phonograms and videograms.

Article 2

The remuneration for sound and / or visual analogue or digital recording shall be paid at

the first sale or importation of devices for sound and / or visual recording, which

according to the manufacturer's declaration enable sound and / or visual recording, such

as:

1. Cassette player, tape recorder or other equivalent device for sound recording 30.00

denars

2. Video recorder and other equivalent device for visual recording 210 denars,

3. Devices for audio recording (CD), devices for audio / video recording (DVD), devices

for recording MiniDisc (MD) and other equivalent devices for sound and / or visual

recording 360 denars.

4. Devices which are not intended only for sound and / or visual recording (PC computer

as a whole, hard drives, USB flash drives, DVD burners, MP3, MP4 players, mobile

phones and other devices with integrated memory) and other equivalent devices

50.00 denars

Article 3

The remuneration for sound and / or visual analogue or digital recording shall be paid at

the first sale or importation of new non ­ recorded sound carriers or sound and image

carriers. The remuneration applies to each individual carrier, which, according to the

manufacturer's declaration enables sound and / or visual recording of works, such as:

1. Analogous carriers:

Audio­cassette, videotape, tapes and other appropriate medium:

a) Sound carriers with duration up to 120 min.

b) Sound carriers with duration over 120 min.

c) Sound and image carriers with duration up to 180 min.

d) Sound and image carriers in duration over 180 min.

2. Digital carriers:

Audio (CD), video (DVD), MiniDisc (MD) and other suitable carrier

For each started 90 minute of the recording time 1.00 denars

b) Portable carrier with integrated memory unit, which is intended only for visual

recording for:

­ Carrier that includes a memory capacity up to 16 GB of 250.00 denars

­ Carrier with a memory capacity over 16 GB 510.00 denars

c) Carrier which is not exclusively designed for audio and / or visual recordings: audio

data (CD), video data (DVD), computer hard drive, memory card (eg CF, SD, SDHC)

transmission carrier with an integrated memory unit which is not exclusively designed for

digital audio and / or visual recordings (eg mobile phone, portable computer) and other

suitable carrier.

For each launched 1 GB memory capacity

2.00 denars, but not more than 1,020.00

denars

Article 4

(1) The remuneration for photocopying shall be paid for the first sale or importation of

new devices for photocopying, for each device, which according to the manufacturer's

declaration enables photocopying or other reproduction techniques with the same effect

of photocopying (fax, printer, photo printer and other equivalent device) with an effect:

1. Up to 12 copies / ppm 200.00 denars

2. From 13 to 36 copies / ppm 300.00 denars

3. Over 36 copies / ppm 500.00 denars

4. Other devices regardless of the effect

(Scanner, etc.) 80.00 denars

(2) The amount of the remuneration under paragraph (1) of this Article for each device

for color photocopying is in double amount, compared to the amount determined under

paragraph (1) of this article.

Article 5

(1) The remuneration for each copied sample intended for sale to a natural person, made

in black and white is 1% of the selling price for each copied sample.

(2) The amount of the remuneration under paragraph (1) of this Article for each sample

copied in color, intended for sale to natural persons is in double amount, compared to the

amount determined under paragraph (1) of this article.

Article 6

On the day of entry into force of this Decision, the Decision on the amount of total

compensation for the reproduction of copyright work for private use ("Official Gazette of

RM" no. 25/08), shall cease to be valid.

Article 7

This Decision shall enter into force the eight day after the day of its publication in

the"Official Gazette of the Republic of Macedonia".
