The notification by Mexico to the WTO under article 63.2 of TRIPS states:
'The Declaration provides for protection of the appellation of origin 'Yahualica' in order to protect the fresh and dried chile de árbol (tree chili) fruit belonging to the species with the following taxonomic classification: Kingdom: Plantae; Division: Magnoliophyta; Class: Magnoliopsida; Order: Solanaceae; Family: Solanacea; Genus: Capsicum L., 1753; and Species: annuum L., 1753.
Yahaulica chili is produced in 11 municipalities, of which nine (Yahualica de González Gallo, Mexticacán, Teocaltiche, Cañadas de Obregón, Jalostotitlán, Encarnación de Díaz, Villa Hidalgo, Cuquío and Ixtlahuacán del Río) are located in the Los Altos region of the State of Jalisco, and two (Nochistlán de Mejía and Apulco) in the State of Zacatecas.
The cultivation of the Yahaulica chili has given rise to a whole culture stemming from the artisanal process through which the fruit is obtained, setting it apart from chilis produced in other Mexican regions and states and making it an essential part of the local diet and the key component of many dishes in Jalisco's cuisine. It is thus seen by the population as a symbol of identity, and is reflected in all cultural events featuring their traditions.'
