Regulation on the Collection of Fees under the Trademark Law

Ordinance of 1 April 1997

regarding the Collection of Fees under the Trademark Act

Based upon Article 29 Paragraph 3 and 4, Article 40, Article 42 Paragraph 2 and Article 72 of the Law of 12 December 1996 regarding the Protection of Trademarks and Geographical Indications (Trademark Act), Liechtenstein Law Gazette 1997 No.60 the Government decrees:

Article 1 Range of application

This Ordinance applies to the fees which the Office of National Economy levies on its own activities. The applicable international agreements remain unaffected.

Article 2 Determination of the fees

1) The fees payable under the Trademark Act and on the basis of the associated Ordinance are determined in the Appendix.

2) The Office of National Economy may request compensation for special applications; the criteria for the amount of compensation due are the time spent and costs which are incurred.

Article 3 Payment

1) The fees shall be paid in advance to the department of financial control (Landeskasse).

2) The provisions of the Trademark Act and the associated Ordinance remain unaffected.

Article 4 Method of payment

The fees shall be paid in Swiss Francs by any of the methods of payment declared by the Office of National Economy to be acceptable.

Article 5 Indications of payment

1) Each payment must include the name of the person making the payment and exact indications as to the purpose of the payment.

2) If these indications are not provided, the Office of National Economy shall request the person making the payment to advise it of the purpose of the payment in writing. If this request is not satisfactorily answered, the payment shall be considered as not having been made. Article 8 remains unaffected.

Article 6 Receipt and validity of the payment

1) The credit entry to one of the accounts of the Office of National Economy shall be considered as the receipt of payment.

2) If a payment is credited later than the date specified by the Office of National Economy, an earlier date of payment may be recognised if suitable evidence can be provided by the stamp mark on the deposit slip, the Giro receipt, the payment instructions or by some other document of equal merit.

3) In the case of payment orders with a validity date later than the payment date, Paragraph 2 does not apply.

Article 7 Payment in due time

1) If the fee is not fully paid within the specified time limit, the payment shall be considered as not having been made. Article 8 remains unaffected.

2) It is the responsibility of the person liable to pay to provide evidence of payment by the specified time.

Article 8 Repayment of fees

In the event of a repayment of a sum that was not owed or of an incompletely-paid sum the Office of National Economy may charge a handling fee; this amounts to 10% of the sum to be repaid subject, however, to a minimum fee of 50 Francs.

Article 9 Costs of publications

1) The filing fee includes 200 Francs for publication in the official publication organs. If the costs of publication exceed 200 Francs, a fee shall be charged to cover that excess.

2) The extension fee includes the costs of publication in the official publication organs.

3) The costs for the publication of modifications and rectifications in the official publication organs shall be paid by the filer.

Article 10 Transitional provisions

1) The determination and payment modalities of fees resulting from an event which occurred before this Ordinance entered into force shall comply with the previous law.

2) If a fee is paid under the previous law and the missing amount is paid within the time limit set by the Office of National Economy, the time limit of receipts of payment within the first six months of this Ordinance entering into force shall be considered as observed.

Article 11 Repeal of previous legislation

The Ordinance of 27 November 1990 regarding the registration fees for entries relating to the protection of the manufacturing and trading marks, geographical indications of goods and the commercial distinguishing signs, Liechtenstein Law Gazette 1990 No. 82, shall be repealed.

Article 12 Implementation

This Ordinance enters into force on the day of public notice.
