的外交会议决议

1. 2006年3月在新加坡举行的通过经修订的《商标法条约》的外交会议议定,将外交会议所通过的条约命名为“《商标法新加坡条约》”(下称“本条约”)。

2. 在通过本条约时,外交会议议定,第一条第(8)项中的用语“向商标主管机关办理的业务”不涵盖缔约方立法规定的司法程序。

3. 外交会议承认本条约为缔约各方有效规定了高效率的商标形式程序,并达成谅解,无论是第二条还是第八条,均不要求缔约各方承担以下任何义务:

      (i) 注册《实施细则》细则三第四款、第五款和第六款所述的新型商标;或

      (ii) 实行电子申请系统或其他自动化系统。

每一缔约方均应可以选择决定是否以及何时开展上文所述新型商标的注册工作。

4. 为方便发展中国家和最不发达国家(LDCs)执行本条约,外交会议请世界知识产权组织(WIPO)和缔约方提供适当的额外技术援助,包括技术、法律及其他形式的支助,以加强这些国家执行本条约的机构能力,使其得以全面利用本条约的规定。

5. 此种援助应考虑受援国的技术和经济发展水平。通过提供技术支助,将有助于改善这些国家的信息与通信技术基础设施,从而帮助缩小缔约各方之间的技术差距。外交会议注意 到,一些国家强调,数字团结基金(DSF)在缩小数字鸿沟方面具有极其重要的作用。

6. 此外,本条约生效后,缔约各方将着手在多边基础上,交流和共享有关本条约执行工作的法律、技术和机构层面以及如何全面利用因此而带来的机会与利益方面的信息与经验。

7. 外交会议承认最不发达国家的特殊处境与需求,并一致同意为最不发达国家执行本条约提供以下特别和优惠的待遇:

    (a) 最不发达国家应重点成为缔约各方和世界知识产权组织(WIPO)提供的技术援助的主要受益国;

    (b) 此种技术援助包括以下内容:

      (i) 帮助建立执行本条约所需的法律框架,

      (ii) 就加入本条约所产生的影响开展宣传、教育和提高认识工作,

      (iii) 帮助改变国家商标注册机关的行政做法与程序,

      (iv) 帮助各知识产权局建立一支经过必要训练的队伍和各项设施,其中包括为有效执行本条约及其实施细则开展信息与通信技术方面的能力建设。

8. 外交会议请大会在每一届例会上监测和评价与执行本条约有关的援助方面的进展以及执行本条约所带来的利益。

9. 外交会议议定,两个或多个缔约方之间在解释或适用本条约方面可能产生的争议,应在总干事的主持下,通过协商和调解的方式友好解决。
