Permitir el registro de marcas que pretendan distinguir productos cuya redacción es tan amplia que no permite individualizar al producto en concreto, crea una situación de inseguridad jurídica para el titular, ya que una marca inscrita en tales condiciones es considerada débil, y no impediría el registro de una marca similar cuyos productos vayan claramente delimitados, todo esto en aplicación del principio de especialidad. Así, al permitirse el registro de este tipo de marcas, se crea una supuesta expectativa jurídica de parte del titular de que le será protegida por parte del Registro una marca relacionada a una multiplicidad de productos, lo cual no es cierto. Además, éstos registros débiles conllevan a una situación de falta de transparencia en el mercado, ya que los competidores del ramo de que se trate no pueden tener certeza de cuáles son los productos distinguidos con una marca, porque su registro indica una categoría muy amplia de ellos. Esa falta de transparencia respecto de las demás empresas del mismo sector empresarial se traduce en competencia desleal, práctica que se pretende desterrar con la emisión de la Ley de Marcas bajo comentario.
