THE LAW OF THE REPUBLIC OF MOLDOVA NO. 65-XV OF APRIL 12, 2001 for completing the Law no. 588-XIII of September 22, 1995 on trademarks and

appellations of origin

The Official Bulletin of the Republic of Moldova no. 55-56/336 of May 24, 2001

The Parliament of the Republic of Moldova shall adopt the present organic law:

Article I: the Law no. 588-XIII of September 22, 1995 on trademarks and appellations of origin (The Official Bulletin of the Republic of Moldova, 1996, no. 8-9, art. 76), with amendments and completions, shall be completed as follows:

1. Article 6: Two new paragraphs (4) and (5) shall be introduced after the paragraph (3) with

the following contents: “ (4) the exclusive right shall not extend to the trademarks, lawfully owned and

used until January 1, 1992 by two or more legal persons. Further use of the mentioned trademarks by these legal persons or their successors in rights shall not be considered as infringement of the owner’s right of the registered trademark.

(5) The trademarks, which lawfully existed and were used until January 1, 1992, by two or more legal persons, are declared by the property of state. The order of their use is determined by the Government in the special regulations.”

paragraph (4) shall be converted into paragraph (6)

2. Article 7: A new paragraph (5) shall be introduced after the paragraph (4) with the

following content: “ (5) Designations, lawfully owned and used until January 1, 1992, by two or

more legal persons, including their successors in rights, shall not be allowed to be registered as trademarks or its elements, for marking goods of the same type (homogenous, similar).”
