amending Government decision 1074/2007. (X. 1.) Korm. on the appointment and tasks of the government commissioner for the „New Order and Freedom” Programme

In order to restrain black economy and to effectively fight against the infringement of intellectual property rights, and recognising that the protection of intellectual property rights is of paramount importance in the interest of preserving and promoting innovation, competitiveness and cultural diversity as well as protecting consumers and employment, furthermore conscious of the fact that national strategy-making and coordinated action are necessary to render intellectual property protection more efficient, the Government establishes the National Board Against Counterfeiting and makes the following decision:

1. The following new points 2/A and 2/B shall be added to Government decision 1074/2007 (X. 1.) Korm. on the appointment and tasks of the government commissioner for the “New Order and Freedom” Programme:

“2/A. The government commissioner, in cooperation with the Minister of Justice and Law Enforcement and with the heads of other central state administrative organs concerned, shall

a) elaborate the national anti-counterfeiting strategy and the related action plan complemented with indicators of results, and coordinate their implementation; b) participate in the elaboration of anti-counterfeiting action plans, promote the implementation of these actions; c) initiate awareness-raising and explanatory programmes and campaigns, follow with attention their execution; d) contribute to the further training for the staff of enforcement and judicial agencies taking part in the action against counterfeiting; e) make proposals to the competent minister concerning the legislative and regulatory activity serving the enforcement of intellectual property rights.

2/B. a) In fulfilling the duties under 2/A, the government commissioner shall be assisted by the National Board Against Counterfeiting (hereinafter referred to as “the Board”) as an organ performing advisory, opinion-giving and consultative tasks. b) The chairman of the Board shall be the government commissioner, its vice-chairmen shall be the president of the Hungarian Patent Office and a government senior official or a civil servant with senior official assignment designated by the Minister of Justice and Law Enforcement. Members of the Board shall be invited jointly by the government commissioner and the president of the Hungarian Patent Office taking also in account the proposals of NGOs and interest groups concerned with intellectual property protection as well as of entrepreneurial interest groups including intellectual property right holders; the number of non-governmental members shall be 10. c) The secretarial tasks of the Board shall be performed by the staff of the Hungarian Patent Office. d) The budget of the Board shall be planned and presented separately within the budget of the Hungarian Patent Office.”

2. The government commissioner for the “New Order and Freedom” Programme shall submit the national anti-counterfeiting strategy and the related action plan complemented with indicators of results to the Government by 30 June 2008.

3. This decision shall enter into force on 1 February 2008.
