Decree on amounts of remuneration for private and other internal reproduction

 SI041: Copyright, Amounts of remuneration for private reproduction, Decree, 2007

On the basis of Article 39(1) of the Copyright and Related Rights Act (Official Gazette of the

Republic of Slovenia, No. 44/06), the Government of the Republic of Slovenia hereby issues

the following

DECREE

ON AMOUNTS OF REMUNERATION FOR PRIVATE AND OTHER INTERNAL

REPRODUCTION

Article 1

This Decree determines the amounts of remuneration for private and other internal

reproduction made under conditions set out in Article 50 of the Copyright and Related Rights

Act that shall be paid to holders of author’s and related rights by persons referred to in Article

38(1) of that Act.

Article 2

The amount of remuneration for sound or visual fixation of protected works to be paid upon

the first sale or importation of new appliances for sound or visual fixation shall be for each

appliance that, according to the producer declaration, makes possible

1. analogue reproduction of audio and/or visual works, and is designed

for that purpose, namely:

a) appliances for sound fixation:

- tape recorder,

- magnetic recorder, and

- other similar appliances 120 SIT

b) appliances for visual fixation:

- video recorder and

- other similar appliances 900 SIT

2. digital reproduction of audio and/or visual works and written works,

namely:

a) appliances designed exclusively for the reproduction of audio and/or

visual works:

- CD audio writer,

- DVD audio/video writer,

- MD (minidisc) writer, and

- other similar appliances 1500 SIT

b) appliances that are not designed exclusively for the reproduction of audio

and/or visual works:

- CD computer unit,

- DVD computer unit, and

- other similar appliances 200 SIT

Article 3

The amount of remuneration for sound or visual fixation of protected works to be paid upon

the first sale or importation of new blank audio and/or video fixation media shall be for each

blank audio and/or video fixation medium that, according to the producer declaration, makes

possible

1. analogue recording of audio and/or visual works, and is designed for

that purpose, namely:

- audio cassette,

- video cassette,

- magnetic tape, and

- other similar media

a) up to 180 minutes 23 SIT

b) more than 180 minutes 46 SIT

2. digital recording of audio and/or visual works and written works,

namely:

a1) media designed exclusively for the reproduction of audio and/or visual

works:

- CD audio,

- DVD video,

- MDs (minidisc), and

- other similar media

per every initial 90 minutes of recording time

a2) media with integrated memory unit and player, designed exclusively

for the reproduction of audio and/or visual works:

- capacity of up to 2 GB inclusively

- capacity of more than 2 GB

b) media that are not designed exclusively for the reproduction of audio

and/or visual works:

- data CD,

- data DVD,

- hard disc,

- memory card (e.g. CF, SD, SDHC),

- medium with integrated memory unit and player, that is not designed

exclusively for the reproduction of audio and/or visual works (e.g.

mobile phone, pocket PC), and

- other similar media

per every initial GB 8 SIT, but not

more than

4000 SIT

Article 4

(1) The amount of remuneration for photocopying to be paid upon the first sale or importation

of new appliances for photocopying shall be for each appliance that, according to the producer

declaration, makes possible

photocopying or reproduction by techniques similar to

photocopying (fax machines, printers, photoprinters and other

similar appliances):

a) of 3 copies/pages per minute 500 SIT

b) of 12 copies/pages per minute 2000 SIT

c) of 13-36 copies/pages per minute 3000 SIT

d) of 36-72 copies/pages per minute 5000 SIT

e) of more than 72 copies/pages per minute 7000 SIT

f) scanners, irrespective of number of copies 500 SIT

(2) The remuneration for appliances under this Article that make possible the making of only

black and white copies shall be half of the above amounts.

Article 5

The amount of remuneration for photocopying to be paid monthly for the probable number of

photocopies made for sale shall be 1 SIT for each copy made for sale to natural persons.

Article 6

(1) The remuneration referred to in Articles 2 and 3 shall be paid for each appliance or

medium, irrespective of whether it can be imported or sold as a stand-alone product or as a

part of another appliance.

(2) The remuneration for appliances and media referred to in Articles 2, 3 and 4 that may be

classified in different tariff classes shall be levied according to the highest tariff.

Article 7

On the date of entry into force of this Decree, the Decree on amounts of remuneration for

private or other internal reproduction (Official Gazette of the Republic of Slovenia No. 63/98)

shall cease to apply.

Article 8

This Decree shall enter into force on the fifteenth day following its publication in the Official

Gazette of the Republic of Slovenia.
