878. Decree of the Federal Minister for Agriculture and
Forestry on registration fees and examination fees
under the Species Protection Act

On the basis of § 28, paragraphs 1, 2, 4, and 5 of the Species Protection Act, BGBl. No. 108/1993 and in agreement with the Federal Ministry for Finances, it is ruled that:

§ 1. The registration fee is set at ATS 2,190.
§ 2.-
(1) The examination fees for the examination of species (register control) carried out by the Agency for the Protection of Species and other domestic control agencies are set as follows:
1. for cereals, maize, potato, sugar-beet, pea, grain rape, and
sunflower ATS 3,850
2. for forestry species ATS 550
3. for all other plant species ATS 2,750
(2) If at the beginning of the vegetation period following the registration of species protection the Agency for the Protection of Species has complete examination results at its disposal that meet the requirements of § 5, paragraph 2 to 4 of the Species Protection Act and have been collected by the Agency for the Protection of Species or another domestic control agency or a control agency of an EEC Member State in the course of a procedure other than the one prescribed under the Species Protection Act or in the course of an application for registration of a species in the register for cultivated plants (§ 4, paragraph 1 of the Law on Plant Cultivation, BGBl. No. 34/1947), the examination fee for the examination of species shall amount to ATS 2,190.
§ 3.
(1) This decree shall enter into force on January 1, 1996.
(2) The decree of the Federal Minister for Agriculture and Forestry on the registration fee and examination fees under the Species Protection Act, BGBl. No. 1036/1994, shall be annulled as of December 31, 1995.
