 Federal Law No. 195-Fz of July 23, 2013 on Amending the Criminal-Procedural Code of The Russian Federation and The Code of Administrative Offences of The Russian Federation

NO. 195-FZ OF JULY 23, 2013 ON AMENDING THE CRIMINAL-PROCEDURAL CODE OF THE RUSSIAN

FEDERATION AND THE CODE OF ADMINISTRATIVE OFFENCES OF THE RUSSIAN FEDERATION

Adopted by the State Duma on July 2, 2013 Endorsed by the Federation Council on July 10, 2013

Article 1 The following amendments shall be made to the Criminal-Procedural Code of the

Russian Federation (Sobranie Zakonodatelstva Rossiyskoy Federatsii, 2001, No. 52, Article 4921; 2003, No. 27, Article 2706; 2006, No. 31, Article 3452; 2007, No. 24, Article 2830; No. 50, Article 6236; 2010, No. 17, Article 1985; No. 27, Articles 3427, 3428; 2011, No. 29, Article 4286; No. 50, Article 7350; 2012, No. 24, Article 3070; No. 31, Article 4332; No. 449, Article 6752):

1) in Item 10.1 of Part Two of Article 29 the words "Item 3" shall be replaced by the words "Items 3 and 6":

2) Item 2.1 with the following content shall be added to Part Three of Article 81: "2.1) the light industry goods withdrawn from illegal turnover whose list is

established by the Government of the Russian Federation are subject to destruction in the procedure established by the Government of the Russian Federation;";

3) in Article 82: a) Item 6 with the following content shall be added to Part Two: "6) of the light industry goods withdrawn from illegal turnover whose list is

established by the Government of the Russian Federation shall be transferred for destruction on the basis of a court decision in the procedure established by the Government of the Russian Federation, a record of it to be drawn up in compliance with the requirements of Article 166 of this Code. A sample of the light industry goods withdrawn from illegal turnover which is sufficient for making a comparative examination shall be attached to a criminal case-file.";

b) in Part 4.1 the words "Item 3" shall be replaced by the words "Items 3 and 6".

Article 2 The following amendments shall be made to the Code of Administrative Offences

of the Russian Federation (Sobranie Zakonodatelstva Rossiyskoy Federatsii, 2002, No. 1, Article 1; 2005, No. 19, Article 1752; No. 40, Article 3986; 2006, No. 1, Article 4; 2007, No. 41, Article 4845; 2010, No. 30, Article 4006; 2011, No. 1, Article 10; No. 29, Article 4289; No. 50, Article 7352; 2013, No. 14, Article 1641):

1) Item 2.1 with the following content shall be added to Part 3 of Article 29.10: "2.1) the light industry goods withdrawn from illegal turnover whose list is

established by the Government of the Russian Federation are subject to destruction in the procedure established by the Government of the Russian Federation;";

2) Part 4 with the following content shall be added to Article 32.4: "4. The confiscated light industry goods whose list is established by the

Government of the Russian Federation are subject to destruction in compliance with a court decision in the procedure established by the Government of the Russian

Federation.".

Article 3 This Federal Law shall enter into force upon the expiry of one hundred and eighty

days as from the date when it is officially published.
