October 22, 2016

Slovenia: The Collective Management of Copyright and Related Rights Act was adopted on September 22, 2016, published in the Official Gazette on October 10, 2016, and came into force on October 22, 2016.  It repeals the provisions regarding copyright collective management in the Copyright and Related Rights Act.

The Act introduces new regulations relating to, inter alia: i) the mandatory collective management for non-theatrical musical and literary works, reproduction of works for private and other internal use, and copying and cable retransmission of works; (ii) the multi-territorial licensing of rights for online musical works; (iii) the freedom of right holders to choose their collective management organizations; (iv) equal treatment of categories of right holders and equitable distribution of royalties; and (v) the effective dispute resolution mechanisms managed by the Copyright Board, in particular in relation to tariffs for the use of authors' works, licensing conditions, and entrustment and withdrawal of rights.
