Year of Version 2007 Dates Entry into force: August 24, 2007 Type of Text Constitution/Basic Law Subject Matter Other Notes The Kingdom of Thailand is a constitutional monarchy, and the Constitution is the supreme law of the country. The 1997 Constitution is the 18th constitution of Thailand since the country moved from an absolute monarchy to a democracy in 1932.

The Constitution contains the general provisions concerning intellectual property rights in Part 9 'Directive Principles of State Policies in relation to Science, Intellectual Property and Energy' (see page 40), Chapter V 'Directive Principles of Fundamental State Policies'.
The Constitution does not contain any provisions that specifically refer to copyrights and industrial property rights. However, the Constitution guarantees sui generis rights for the respect and full protection of genetic resources, biodiversity, traditional knowledge and traditional cultural expressions. The Constitution protects: the right to preserve and develop local knowledge and Thai wisdom (Section 86 (2), Part 9, Chapter III), the right to conserve or restore their customs, local knowledge, good arts and culture of their community (Section 66, Part 12 'Community Rights', Chapter III), right to preserve and exploit the natural resources, the environment and the biological diversity (Section 66 & 67, Part 12 'Community Rights', Chapter III).

The Constitution also contains the provisions that define the protection and promotion of all forms of property rights in Part 5 'Rights to Property' (see page 16), Chapter III 'Rights and Liberties of the Thai People'.
