Year of Version 1999 Dates Entry into force: November 5, 1995 Adopted: November 5, 1995 Type of Text Implementing Rules/Regulations Subject Matter Trademarks, Geographical Indications, IP Regulatory Body Notes The notification by Turkey to the WTO under article 63.2 of TRIPS states:
'Part 1, Section 2 of the Decree-Law explains the signs of which a trademark may consist and means whereby a trademark is obtained in line with Article 15 of the TRIPS Agreement.
Part 3, Sections 2 and 3 of the Decree-Law states publication of the application and observations and oppositions by third parties are also in line with Article 15 of the TRIPS Agreement.
Part 1, Section 3 of the Decree-Law explains the scope of protection of trademarks is in line with Article 16 paragraph 1 of the TRIPS Agreement.
According to Article 7/I of the Decree-Law, Well known marks according to 6bis of the Paris Convention, use of which are not permitted by their owners shall not be registered as a trademark
According to Article 8 paragraph 4, a trademark applied for, which is identical or similar to a registered trademark or to a trademark with an earlier filing date may be used for different goods and services.
However, where in the case of a registered trademark or of a trademark which has an earlier filing date for registration, the trademark has a reputation and where the use without due cause of trademark applied for would take unfair advantage of, or be detrimental to the distinctive character or repute of the registered trademark or of the trademark with an earlier application date, upon opposition by the proprietor of the earlier trademark, the trademark applied for shall not be registered even to be used for goods and services which are not similar to those for which the earlier trademark is registered.

The provisions of Decree-Law shall apply, mutatis mutandis to services.
Exceptions mentioned in Article 17 of the TRIPS Agreement are regulated in Article 12 of the Decree-Law.
According to Articles 40 and 41 of the Decree-Law a trademark is registered for a period of ten years; registration may be renewed for further periods of ten years indefinitely. These Articles are in line with Article 18 of the TRIPS Agreement. Article 14 is in line with Articles 19 and 20 of the TRIPS Agreement.
Part 1, Section 5 is in line with Article 21 of the TRIPS Agreement.'

Madde 7/i’ye göre, Paris Sözleşmesi 6bis göre bilindik markaların sahipleri tarafından kullanımına izin verilmeyenleri marka olarak tescil edilemez.
KHK md. 8 paragraf 4 göre, aynı veya tescilli bir marka ya da bir önceki başvuru tarihili bir marka benzer bir markanin farklı mal ve hizmetler için kullabilir.
Ancak, daha onceden tescil edilmis yada tescil basvurusu yapilmis bir marka varsa ve bu markanin itibari varsa ve tescili icin basvurulan marka haksiz avantaj yaratacaksa önceki unlu marka sahibinin itirazı üzerine farkli hizmet ve mallarda kullanilacak olsa bile yeni marka tescil edilemez.
556 sayılı KHK hükümleri mutatis mutandis olarak hizmetler icin de uygulanir.
556 sayılı KHKnin 12. maddesinde TRIPS'in 17. maddesinde yer alan istisnalar düzenlenmiştir.KHK'nin 40 ve 41 maddelerine göre on yıllık bir süre için bir tescil kaydı yapılan marka süresiz olarak on yıl daha fazla süreler için uzatılabilir.Bu maddeler, TRIPS 18. md. doğrultusundadir.
TRIPS md. 19 ve md. 20 ile paralel olarak 556 sayılı KHK'nin 14 üncü md. 556 sayılı KHK'nin 1, 5. Bölüm, TRIPS'in 21. maddesi doğrultusunda açıklar.'
