This consolidated version of the Northern Ireland Act 1998 (Chapter 47) takes into account amendments up to the Protocol on Ireland/Northern Ireland (Democratic ConsentProcess) (EU Exit) Regulations 2020 (S.I. 2020/1500), which entered into force on December 10, 2020.
The said amending Regulations 2020 (S.I. 2020/150) inserted Part 5A and Schedule 6A (EU Withdrawal: Democratic Consent Process) to the consolidated version.
Paragraph 27 under Schedule 3 (Reserved Matters) of this consolidated version defines reserved matters, inter alia, for intellectual property but not the subject-matter of Parts I and II of the Plant Varieties Act 1997 (plant varieties and the Plant Varieties and Seeds Tribunal).
Paragraph 8 under Schedule 13 (Minor and Consequential Amendments) introduced the amendments to the following provisions of the Copyright, Designs and Patents Act 1988 (c. 48):
- Sections 164(1), 178 & 179 amended;
- Section 166(B) inserted.
Schedule 15 (Repeals) provides for the repeal of the entry in paragraph 1(2) relating to the Northern Ireland Constitution Act 1973 under Schedule 4 of the Trade Marks Act 1994.
