This is a revised edition of the Sale of Food and Drugs Act (Chapter 9.26, also known as Act No. 18 of 1987) was prepared on December 31, 2002, by the Law Commission under the authority of the Law Commission Act, 2012 (Cap. 1.03), which takes into account amendments up to Act No. 7 of 1976 (see sections 2 and 28 for the amendments).
Section 6 (b) of this revised version of the Sale of Food and Drugs Act provides that an offence shall not be deemed to be committed for the sale of articles of food and of drugs not of the proper nature, substance and quality in cases where the drug or food is a proprietary medicine or is the subject of a patent in force and is supplied in the state required by the specification of the patent.
