Year of Version 2016 Dates Amended up to: June 24, 2016 Entry into force: September 6, 2008 Published: June 6, 2008 Adopted: February 29, 2008 Type of Text Main IP Laws   Subject Matter Trademarks Subject Matter (secondary) Enforcement of IP and Related Laws, IP Regulatory Body, Competition, Alternative Dispute Resolution (ADR) Notes The notification by the Republic of Moldova to the WTO under article 63.2 of TRIPS states: 'By Law No. 101 of 26.05.2016 Amending Certain Legislative Acts were adopted modifications and consolidations of certain legal texts in the intellectual property field in order to comply the regulatory framework which is in force with the provisions of Law No. 114 fom 03.07.2014 on the State Agency on Intellectual Property of the Republic of Moldova. By Law No. 162 of 30.07.2015 Amending and Supplementing Certain Legislative Acts (link to English version can be found under 'Other information' below) were adopted modifications and consolidations of certain legal texts in the intellectual property field, namely: Law on the Protection of Trademarks was supplemented with new signs susceptible to be registered as marks, being included the holograms, the positioning signals, the olfactory, tactile and auditory signs. Changes were made in the legal rules regarding the absolute and relative grounds for refusal, the limitation of the exclusive right, the refusal of trademark registration demand, the registration and renewal of registration, etc.' Articcle 86, paragraph (2) under Chapter IX (Final and Transitional Provisions) of this Law No. 38-XVI states that from the day of entry into force of this Law, "Law No. 588XIII of September 22, 1995, on Trademarks and Appellations of Origi" insofar as it relates to trademarks, shall be recognized as having been repealed.
