This consolidated version of the Family Code takes into account amendments up to Federal Law No. 317-FZ of November 25, 2013, which entered into force on November 25, 2013, on the day of its official publication on the website of Official Internet-Portal of Legal Information (http://www.pravo.gov.ru), except for the provisions set out in Article 64, which entered into force on different dates.
For the amendments introduced by the said Federal Law No. 317-FZ, see the following provisions of this consolidated version:
- Section II, Chapter 3, Article 15, paragraphs 1 and 2;
- Section IV, Chapter 10, Article 48, paragraph 1; Chapter 11, Article 55, paragraph 2; Chapter 12, Article 66, paragraph 4, and Article 69, paragraph 3;
- Section V, Chapter 13, Article 84, paragraph 2;
- Section VI, Chapter 18, Article 122, paragraph 1; Chapter 19, Article 127, paragraph 1, subparagraph 7, and Article 131, paragraph 1, subparagraph 3; and Chapter 20, Article 146, paragraph 3.
Article 34(2) and 36(3) under Chapter 7 of Section III of this consolidated Family Code relate to marital property and intellectual property.
Article 34(2) provides that assets acquired during the marriage are considered as community property, among others, the income from the exploitation of intellectual property.
Article 36(3) provides that the exclusive rights to intellectual property created by one spouse during marriage are considered that spouse’s personal property.
