This consolidated version of 1995 of the Patent Act of 1936, which was revised and re-published on December 16, 1980, incorporates amendments up to Article 13(1) of the Trade Mark Reform Act of October 25, 1994, which came into force on January 1, 1995.
The notification by Germany to the WTO under article 63.2 of TRIPS states:
'The Patent Act contains the basic provisions on the protection of patents. Included are provisions regarding availability, scope, infringement, the proceedings before the Patent Office, the Patent Court, the Federal Court of Justice and the procedure in patent litigation.'
Article 2(2) excludes plant and animal varieties from the scope of the law.
