Notes
This consolidated version of the Law on Administrative Procedure incorporates all the amendments up to August 13, 2001 (see Title III, Article 7(f) for the amendments made by Decree No. 1.023/2001 of August 13, 2001).
The Law on Administrative Procedure provides for administrative rules of procedure to be used in relation with the National Public Administration, both central and local, including autonomous bodies, except for military, defense and security agencies.
The National Institute of Industrial Property, an autonomous administrative body, implements the administrative procedures concerning intellectual property rights. For example, Title V of the Law on Patents and Utility Models streamlines administrative procedures relating to patent applications and proceedings, which are undertaken by the National Administration of Patents.
Article 33 of the Law stipulates that it shall take effect 120 days after its publication in the Official Gazette. The Law was published in the Official Gazette on April 27, 1972 (B.O. 27/04/72), and shall enter into force 120 days from this date.
