The notification by Canada to the WTO under Article 63.2 of TRIPS states:
The Patented Medicines (Notice of Compliance) Regulations 'allows an innovator to bring an application to prohibit the granting of marketing approval (Notice of Compliance) for a drug, that relies upon the earlier approval of a related drug until all the relevant product and use patents (but not process patents) pertaining to the earlier approved medicine have expired.'
