Year of Version 2001 Dates Entry into force: December 9, 2001 Issued: December 8, 2001 Type of Text Implementing Rules/Regulations Subject Matter Industrial Designs, Enforcement of IP and Related Laws, IP Regulatory Body Notes These Regulations, issued pursuant to section 2(2) of the European Communities Act 1972, make amendments to the Registered Designs Act 1949 in order to implement the Directive 98/71/EC of the European Parliament and of the Council of 13 October 1998 on the legal protection of designs (“the Directive”). In particular, regulation 2 to 8 give effect to the main requirements of the Directive and, among others, make amendments to the following sections of the Registered Designs Act 1949: - Section 8B(6) (effect of order for restoration of right); - Section 14 (registration of design where application for protection in convention country has been made); - Section 15(2) of that Act (extension of time for applications under Section 14 in certain cases); - Section 19 (registration of assignments etc.) - Section 22 (inspection of registered designs); - Section 25(certificate of contested validity of registration); - Section 35 (fine for falsely representing a design as registered); - Section 36(1A) (general power of Secretary of State to make rules etc.); - Section 44 of that Act (interpretation).
