This Directive is intended to remove trademark law “disparities which may have impeded the free movement of goods and freedom to provide services and may have distorted competition within the common market,” through the approximation of Member legislative systems. The Directive applies to “every trade mark in respect of goods or services which is the subject of registration or of an application in a Member State for registration as an individual trade mark, a collective mark or a guarantee or certification mark . . . .” Finally, the Directive may require national legislative action within the Member States to reach the stated end goals.
