Year of Version 2015 Dates Adopted: July 24, 1889 Type of Text IP-related Laws Subject Matter Enforcement of IP and Related Laws, Other, Industrial Property Notes This consolidated text of the Civil Code incorporates all the amendments up to Law No. 42/2015 of October 5, 2015, which was published in the Official Gazette on October 6, 2015, and entered into force on October 7, 2015.
The 'First Final Provision' of the said Law introduces changes to Article 194 of Chapter III, Title XVIII, Book 4 of the Code.

Article 10, paragraph 4 under Chapter IV, Preliminary Title of the Civil Code states that intellectual and industrial property rights shall be protected within Spanish territory in accordance with Spanish law, subject to the provisions of international treaties and conventions to which Spain is a party.
Articles 428 and 429 under Chapter III, Title IV, Book II of Civil Code provide that the author of a literary, scientific or artistic work has the right to exploit it and dispose of it according to his wishes; and that the Intellectual Property Law fixes the persons to whom the right pertains, the form of its exercises, and its duration; and in cases not determined by the said law, the general rules on property regimes, established by this Code shall govern.
