Changes since the previous (2007) version are as follows:
-Articles 3b and 6 in Part I 'General Provisions' of this Act;
- Article 7 in Part II 'The Patent Application and its Processing';
- Artilce 45 in Part VI 'Licensing, Transfer, etc.'
- Article 68 and 69 in Part X 'Miscellaneous Provisions';
- Article 75 in Part X a European Patents.
This version of the Patents Act 1977 provides provisions on patent flexibilities, namely compulsory licenses and government use (article 45-49); research exemption(article 3(2)), regulatory review exemption (article 3(2) and exhaustion of rights (article 3(2)).
The Patents Act No. 17/1991 gives effect to certain international conventions on patents. Articles 28 and 75 provide for the effect in Iceland of the European Patent Convention (EPC) and the Patent Cooperation Treaty (PCT).
Article 91 of this Act stipulates: 'This Act shall enter into force on January 1 1992. Patents for medicinal products can be granted after June 1 1996 on the basis of applications filed after January 1 1995.
2) Patents for stimulants or foodstuffs can be granted on the basis of applications filed after January 1 1992.
3) The Provisions of Part III of this Act shall not enter into force until a public notification has been made that Iceland is a member of the Patent Cooperation Treaty.
The provisions of Articles 8, 22 and 56 of this Act concerning the deposition of samples of biological material shall not enter into force until the date has been set by regulation and shall only apply to applications filed after the said date.'
