Year of Version 2013 Dates Entry into force: July 1, 2011 Adopted: May 12, 2010 Type of Text Implementing Rules/Regulations Subject Matter Patents (Inventions), Undisclosed Information (Trade Secrets), Other Notes The notification by Switzerland to the WTO under Article 63.2 of TRIPS states that:
Article 46 provide appropriate protection for test and study reports.(protection for up to ten years).
Article 47 provide protection for reports in the event of renewal or re-examination of authorization.
The most recent amendment in Article 47.3 of the revised version of February 1, 2013, of the Ordinance on the Marketing of Phytosanitary Products refers to use of reports submitted in the event of renewal or re-examination to adapt the conditions of use of a product for which the test and study reports have not been provided.
Article 47.3 was amended by Chapter 1 of the Ordinance of May 23, 2012, amending Ordinance on the Marketing of Phytosanitary Products (RO 2012 3451), and entered into force on December 1, 2012.

Chapter 5 provides for protection of fabrication and business secrets of phytosanitary products.
