Article 73 of Law No. 2014-344 of March 17, 2014, on Consumer Protection introduces the following changes to the Intellectual Property Code (the 'IPC'):
-Creating the new Article L.711-4(d) of the IPC which adds the indications of origin to the list of prior rights that can be invoked by a third party in a cancellation action against a trademark;
-Creating the new Article L.712-2-1 of the IPC which allows local authorities to be informed by the French IP Office in case of filing by a third party of a trademark application including their protected names or region names located on their geographical territory.
-Amending Article L.712-4 of the IPC by adding two new categories of persons including the territorial authorities and defense organizations (other than trademark owners or exclusive licensees), who are entitled to file opposition against trademark applications reproducing the name of a territorial authority or the name of a geographical indication;
-Creating the new Article L.721-2 of the IPC that provides a new kind of geographical indication for non-agricultural products (i.e. industrial and artisanal geographical indications).
