Notes This version of the Law on Inventions incorporates all amendments up to Law No. 857 of July 3, 2012.
The amended provisions made by Law No. 857 of July 3, 2012 under this version include the following:
-Article 1 was expanded with the addition of paragraph 4 which defines the term “license”.
-Part 9 of Article 26 was revised and expanded, relating to compulsory license of patents.
-Article 27 was supplemented with part 9, which provides the Law of the Republic of Tajikistan “on licensing of certain types of activities” shall not cover granting of licenses to use an invention.
- Paragraph 3 of part 1 of Article 30 was amended in order to specify the conditions for use of patents in force majeure circumstances, which is not recognized as an infringement of a patent owner’s exclusive right.
-Article 30 was supplemented with part 2, which states that action provided for in this Article shall not unreasonably conflict with a normal exploitation of the patent and do not unreasonably prejudice the legitimate interests of the patent owner.
